order relative to such securing of the ground as he may deem necessary.
185.—Machinery to Represent Labour.
In all claims where machinery is erected, such machinery shall represent one man for every two hundred and fifty pounds (£250), expended in procuring and erecting the same : but should any dispute arise in reference to the amount so expended, the onus of proof of such expenditure shall lie with the owner of the machinery.
186.—Warning in Case of Blasting.
Ten minutes previous to the discharge of any blast of gunpowder or other explosive substance within fifty (50) feet from the surface of the ground, due notice of such discharge shall be given by persons who shall have prepared or caused such explosion to all other persons working, residing, or passing within a distance of one hundred (100) yards from the place of such discharge.
187.—Neglect of Warden’s Orders.
Any person who shall neglect or refuse to comply with any notice or order of the Warden, duly served and in conformity with these Regulations; and any person committing any breach, whether by way of omission or commission of any of the Rules and Regulations made under the authority of "The Gold Fields Act, 1866," or any amendment thereof, shall for every such breach be liable to a fine or penalty not exceeding ten pounds (£10) for the first offence, and twenty pounds (£20) for any second or subsequent offence.
188.—Warden’s Discretionary Powers not to be Exercised Arbitrarily.
Wherever it is provided that the Warden may grant or refuse any application for any right or privilege under these Regulations, if it shall be proved that the applicant has duly complied with all conditions provided in that behalf, the Warden shall not arbitrarily refuse such application, but shall state his reason for such refusal, and shall give the applicant an opportunity of producing evidence to rebut the reason so given by the Warden.
189.—Precautions against Fire.
When any risk of fire exists from the proximity of any chimneys to any dwelling house or building, or from the lighting of any fire, the Warden may enforce such alterations as he may deem necessary for the safety of the adjoining buildings.
190.—Suspension of Regulations.
If any portion of the Rules and Regulations of the Gold Fields shall be deemed to be inapplicable to the requirements of any district, the Governor’s Delegate may, if he shall think fit, upon the receipt of a memorial to that effect, signed by holders of Miner’s Rights and Business Licences residing in such district, suspend the operation of any Regulation, or section of a Regulation, so far as such district is concerned, and may again annul such suspension, and renew the operation of such Regulation or section, or may substitute others in lieu thereof.

Governor to Issue Miner’s Rights.
IV. It shall be lawful for the Governor to cause documents to be issued in the form set forth in Schedule A hereto annexed each of which shall be called "The Miner’s Right" and shall be granted to any person applying for the same upon payment of the sum of twenty shillings and every such document shall be dated on the day and at the place of issuing the same and shall be in force for the period of twelve months from the date thereof and shall contain the christian name and surname of the person in whose favour the same shall be issued.
Governor to Issue Business Licenses.
V. It shall be lawful for the Governor subject to the provisions of this Act and to such regulations as he may think fit to make for the purpose to cause licenses to be issued in the form set forth in Schedule B hereto annexed which shall be in force for the period for which such license is issued and no longer authorising the holder to occupy Crown Lands and to carry on business upon any gold field within the Province within which such Business License shall have been issued and the fees to be paid for such license shall be five pounds for an annual license three pounds for a half-yearly license and two pounds for a quarterly license Provided always that no person shall be entitled under this Act or any regulations to be made in pursuance thereof to occupy except under a lease more than forty perches of land.
Effect of Miner’s Rights.
VI. Every Miner’s Right to be issued as aforesaid shall during the continuance thereof subject to the provisions of this Act and to the regulations to be made herein provided authorise the holder to cut construct and use water races dams and reservoirs through and upon any Crown Lands and to take or divert water from any spring lake pool or stream situate or flowing through or adjoining Crown Lands and to use such water for mining for gold and for domestic purposes and to mine for gold upon and to occupy for mining purposes and for residence except as against Her Majesty so much of the Crown Lands comprised in any gold field within the Province in which such Miner’s Right shall have been
