III.—PROSPECTING.

10.—Discovery to be Reported.

Every such protected area shall be re
registered every three months, or all right
to such shall at once cease. Protected areas
not to be considered “workings” until the
Prospecting Claim is granted on such areas.

Any person who shall discover any new
gold workings, and who shall be desirous to
obtain a Prospecting Claim, shall mark off an
area of ground as provided in Rule 11, and
shall immediately report such discovery, with
full particulars thereof, to the Warden, who
shall not grant the same until he is fully
satisfied by personal inspection of the ground
that the applicant is entitled to such claim,
and the ground shall be protected until the
Warden shall have granted or refused the
same.

13.—Notices to be Posted by the Warden.

Notices of all Prospecting Claims granted,
with full particulars of locality, yield of gold,
and description of workings, shall be posted
by the Warden on the outside of his office
for public information.

14.—Provision for Showing Shareholders.

Any prospecting party not exceeding six
in number may consist of working and pay
ing shareholders, but the number of working
shareholders shall not be less than one-half
of the whole number of the party; and in the
event of such party discovering payable gold,
the Warden shall be empowered to grant a
Prospecting Claim in the names of the whole
of the shareholders. Provided that within
three days of such granting of the said Pros
pecting Claim, each share is fully represented
upon the ground. Such prospecting party
shall, upon formation, be registered in the
Warden’s office.

11.—Area in Alluvial Ground.

Any person who shall have discovered new
gold workings not exceeding 3 miles distant
from existing workings, may have allotted to
him an extent of ground not exceeding double
the area of an Ordinary Claim; exceeding
three and not exceeding five miles distant
from existing workings, an area not exceeding
treble an Ordinary Claim; and beyond five
miles, an area not exceeding quadruple an
Ordinary Claim. Provided that the increased
grant shall not be given to more than six
persons comprising any party.

12.—Prospecting Area.

The Warden may, upon the application of
any persons forming a party of not less than
four for a prospecting area, register an area
not exceeding 600 yards by 400 yards in
ordinary ground, the same not being within
a radius of one mile of any existing workings,
or within a radius of half-a-mile of any other
such registered area, and shall grant pro
tection for the same, and such protection
shall continue in force until gold be struck,
or the ground abandoned for the space of one
clear day, or until gold workings approach
such protected area within a radius of one
mile. All such areas shall be marked with
posts six inches through, and four feet above
the surface of the ground; and a notice shall
be kept posted on each of such boundary
posts with the words “Prospecting Area”
legibly written on a board not less than nine
inches square. The direc-
tions of the boundaries
shall be shown by
trenches cut from each
side of each corner post
one yard in length, and
one foot in width, thus:
Provided that on gold being struck in any
such protected area, the party shall mark out
the Prospecting Claim to which they are

IV.—WATER RIGHTS AND RACES.

15.—Head Races.

Any person intending to divert and use
water for mining purposes by means of any
head race to be constructed under the
authority of “The Gold Fields Act, 1866,”
shall give notice thereof in writing to the
Warden of the District, and to the holder or
holders (if any) of a prior right or rights of
their intention to divert and use water from
the same source, and such notice shall be in
the form set forth in Schedule A, and copies
of such notices shall be posted and maintained
for fourteen clear days at the source whence
it is proposed to obtain water, and at the
proposed termination of such race; and the
intended course thereof shall be indicated by
pegs not less than two inches square, or by
large stones marked B, and placed not more
than two hundred yards apart, and such
notice shall state the number of sluice heads
the race is intended to carry. And if no
valid objections be entered against such race
within fourteen clear days from the posting
and delivery of such notices, a certificate of
registration may be granted by the Warden
to the applicants.
