And whereas, by the one hundred and ninth Section of the said Act, it is enacted that it shall be lawful for the Governor in Council, under his hand and the Public Seal of the Colony, from time to time to delegate to such person as the Governor may think fit all or any of the powers vested in the Governor by the said Act, except the powers conferred by Sections twenty-two, forty, forty-eight, sixty, ninety-six, and one hundred and seven thereof, subject or not to any limitations or restrictions as he may think fit:
And whereas, by an instrument in writing, dated the third day of February, 1869, and published in the New Zealand Gazette of the eighth day of February, 1869, His Excellency the Governor did, under his hand and the Public Seal of the Colony, delegate unto me, Conrad Hoos, Chairman of the County Council of the County of Westland, all the powers vested in the Governor under or by virtue of “The Gold Fields Act, 1866,” except the powers conferred by sections eleven, twenty-two, thirty-three, thirty-nine, forty, forty-eight, sixty, ninety-six, and one hundred and seven of the said Act, to have, hold, and exercise the said powers hereby delegated to the said Conrad Hoos within the County of Westland;
Now, therefore, I, Conrad Hoos, Chairman of the County Council of the County of Westland, in exercise and pursuance of all the powers vested in and delegated to me in this behalf, do hereby grant unto Hartnett and Co., a Special Claim of six acres, situated on Shenandoah Flat, subject to the undermentioned conditions.
Given under my hand, at Hokitika, this fifth day of October, one thousand eight hundred and seventy.
C. Hoos.
Conditions recommended for Hartnett and party, for special claim, Shenandoah Flat:—
1st. The claim to be surveyed at the expense of Hartnett and party.
2nd. Four men per acre to be constantly employed on the claim.—(This condition may be temporarily relaxed at the discretion of the Warden of the District, provided that at no time shall a smaller number than fifteen men be kept working in the claim.)
3rd. The said Hartnett and party shall pay a yearly rent of One Pound (£1) per acre; in half-yearly payments.
4th. The said Hartnett and party shall have no right to sell or otherwise dispose of any part of the claim; this condition is not to affect the right to sell or dispose of shares.
5th. The said Hartnett and party shall comply with the directions of the Warden of the District as regards the working of the claim.
6th. Clauses 25, 26, and 29, of “The Mining Lease Regulations, 1867,” to be complied with by Hartnett and party.
It is hereby notified, in accordance with the provisions of section forty-three of “The Westland Waste Lands Act, 1870,” that the lands described in the Schedule hereunto annexed are open for sale.

SCHEDULE.
Block XLVIII. (Rural).
Situate in the Okarito District. Bounded on the Northward by Okarito Lagoon, on the Westward by the boundary of the township of Okarito South, on the Southward and Eastward by lines respectively one mile from, and generally parallel to, the Northern and Western boundaries before described.
Block XLIX. (Rural).
Situate in the Waimea District. Bounded on the Northward by Kapitea Creek, and running Southward along the Goldsborough and Greenstone road for two miles and sixty chains, being bounded on the Eastward and Westward by lines distant forty chains from either side of the before mentioned road, so as to give a mean width to the block of one mile.
