remain in force only during such time as the business license shall remain in operation. At the expiration of the time for which the site is registered, if the owner do not take possession thereof or move the building, any person taking such site may either remove the building at the expense of the owner, on receiving an order from the Warden, or purchase the same, the price to be estimated by assessors.
- RIGHT OF MINING ON BUSINESS SITES.
Any person desirous of mining upon land set apart and surveyed for occupation under business licenses shall make application to the Warden, who may allow him to mine upon such land subject to such conditions as he may think fit to impose.
RESIDENCE.
- AREA WHICH MAY BE OCCUPIED FOR RESIDENCE.
Subject to the conditions hereinafter set forth the holder of a Miner’s Right shall be entitled to occupy for residence an area of Crown Lands not exceeding half-an-acre or two thousand four hundred and twenty (2420) square yards.
- SPACE TO BE LEFT BETWEEN RESIDENCE AREAS.
A space of fifteen (15) feet shall at all times be left between Residence Areas for the purpose of a road, and no person shall be entitled to occupy more than one Residence Area.
- RESIDENCE AREAS TO BE REGISTERED.
Any person desirous of occupying land under the preceding regulation shall mark the corners of the area which he proposes to occupy with “T” trenches, or substantial posts standing at least three feet above the surface, and shall give notice in writing in the form hereinafter set forth in Schedule I. to the Warden of the District, and a copy of such notice shall be posted and maintained on the boundary corners of such area for the space of seven (7) clear days, at the expiration whereof, if no valid objection has been entered thereagainst, the Warden may grant a Residence Certificate to the applicant. Provided that if any person does not occupy or reside on such Residence Area within one calendar month from the date of registration, it shall be deemed to be forfeited.
- REGISTRATION FEES.
The fee payable for registering such application shall be five shillings (5s), and the fee for registering any transfer or assignment shall be two shillings and sixpence (2s 6d).
- RIGHT OF MINING ON A RESIDENCE AREA.
If any person be desirous of mining or searching for gold upon any land held as a Residence Area, he may do so, provided that he first lodge in the hands of the Warden a sufficient sum as compensation for any damage which may be done to such Residence Area.
- PRIORITY OF RIGHT TO MINE ON A RESIDENCE AREA.
If any person shall be desirous of occupying any part of a Residence Area for the purpose of mining, he shall lodge a written application with the Warden, and shall also give notice to the owner of such Residence Area of his intention to apply to the Warden for such permission, on a day to be named in such notice (not less than three (3) days from the service thereof). And if no valid objection be raised the Warden shall grant such permission accordingly. Provided that if more than one application shall be made for the same ground at the same time, the Warden may if he deems necessary, decide the priority of right by lot.
- COMPENSATION TO BE PAID.
In all cases compensation for damage or loss shall be estimated by Warden and Assessors, and paid to the occupiers of such area by the persons desirous of mining thereon, or a sufficient sum shall be lodged with the Warden prior to their taking possession thereof, as compensation for such damage as may be done to such Residence Area.
- CONDITIONS OF WORKING.
The Warden shall make such orders relative to the mode of working the ground, the restoration of the soil, and other conditions as he may deem necessary or desirable.
- TENT GROUND.
Subject to the conditions set forth in Sections 3, 4, and 5, the holder of a Miner’s Right shall be entitled to occupy for residence an area of 12 x 24 feet without registration. Provided that such area shall not be taken up on known auriferous ground, nor in the line of any workings, nor on land set apart for business purposes.
- FEES TO BE CHARGED FOR MINING SURVEYS.
The following are the authorised charges for Surveys —
Leases not exceeding five acres, Ten Pounds.
Exceeding five acres, Fifteen Pounds.
Special sites, under one acre, Two Pounds; every additional quarter acre, Ten Shillings.
Extended claims, same as special sites.
Ordinary claims, Two Pounds.
All other surveys at the rate of Two Pounds for each day or fraction of day for the services of a Surveyor, and all contingent expenses to be charged extra.
ERRATUM.—In Gazette, No. 21, of the 25th June, 1870, in page 99, in the twenty-third line, the figures £279 18s. 2d. should be £379. 18s. 2d.
