SCHEDULE.

  1. Every person wishing to ply as a waterman in Westland must make application in writing to the Chairman of the County Council for a license, and every such application must be signed by two respectable residents in the district for which such application is made.

  2. A fee of one pound must be paid by each applicant on receipt of his license; and if the licensee desire to renew his license, such renewal must be effected on or before the first day of July in each year.

  3. Before a licensed waterman can ply for hire in any boat, he is required to obtain from the Harbour Master a certificate stating that the boat is in good serviceable order for the purposes of passenger traffic, the dimensions of the boat, and the number of passengers such boat is fit to carry.

  4. The name of the boat shall in every case be legibly painted in letters, two inches long, together with the number of the license, of the waterman using such boat in the gunwale of the sternsheets of his boat, as well as the number of passengers as allowed in the before-mentioned certificate.

  5. Any person who shall carry passengers for hire in a boat, and shall not possess a license, any person who shall lend his license to another person to make use of, any person who shall ply for hire in a boat for which a certificate as required by Regulation 3 shall not have been granted, or any licensed waterman charging more than the rates of fares authorised for the place in which he plies, and published in the County of Westland Gazette, or refusing to employ his boat when required to do so, shall forfeit his license, and in addition will be liable to a penalty not exceeding five pounds. But any licensed waterman who is prevented by sickness from plying may, on the production of a medical certificate, be allowed to transfer his license to a person approved of by the Harbour Master for a period not exceeding one month.

  6. No boat shall be allowed to remain at any landing place after discharging passengers, or to make fast to any steps or handrails belonging thereto, or in any way to obstruct the passage to and from such steps; and no boats, casks, timber, or any bulky or heavy article of any description shall be hauled up or down the steps so as to obstruct passengers from landing or embarking, under a penalty not exceeding five pounds.

  7. All watermen, boatmen, carters, porters, and others engaged on any wharf or jetty shall, during the time they are so engaged, be under the control of the Harbour Master. And any person resisting or obstructing the said Harbour Master in the execution of his duty, or using threatening, abusive, or obscene language, either when plying for hire, or on board of, or alongside any vessel, or at any landing place, shall forfeit and pay a sum not exceeding twenty pounds.

  8. The building on any wharf or jetty, known as the “Waterman’s House,” shall be set apart for the use of licensed watermen, and no other person or persons shall be allowed to use or occupy such building. If any person shall persist in using or occupying such building a licensed waterman may report the same to the police, who shall cause such intruders to be immediately removed.

  9. The word Harbour Master in these Regulations shall mean the Harbour Master for the County of Westland, or any officer of the Harbour Department duly authorised in that behalf to act for him.
