shall be found to be insufficient to pay the
expenses of such drainage, it shall be lawful
for the said Drainage Board from time to time,
by a bye-law to be made for that purpose, to
increase the rate to be paid by the then claim-
holders within the said area, so that no such
rate shall exceed six times the amount of the
original rate.

  1. That when, from any cause whatsoever
    as aforesaid, such maximum rate shall be in-
    sufficient to pay the expenses of such drain-
    age, the loss arising from such deficiency
    shall be borne and paid by the said applicant,
    who shall be bound to carry out the terms of
    his application, as set forth in such order
    and bye-law, notwithstanding such defi-
    ciency.

  2. That every applicant shall be bound to
    drain the area applied for by him, if granted
    by the Board, in an efficient manner, and the
    term efficient drainage shall mean that the
    applicant shall pump out all water sent down
    to the drainage shaft.

  3. That all monies due as rates or charges
    under this bye-law shall be payable to the
    Clerk of the Jones’s Flat Mining Drainage
    Board, who shall forthwith lodge the same in
    the Bank of New Zealand; such rates or
    charges to be collected weekly, or at such
    other periods as the Board may direct.

  4. That said rates shall be levied and
    paid to the holder of a drainage area at such
    times and in such amounts as may be agreed
    upon between such holder of a drainage area
    and this Board.

  5. For the purpose of this bye-law the
    word “claim” shall apply to and include any
    ground held under miner’s rights, or any gold
    mining or mineral lease.

The words “owner” or “owners” of any
drainage machinery shall include the mort-
gagee in possession, and the person or persons
to whom any claim or any drainage machinery
erected thereon shall have been let on tribute
or otherwise.

NOTICE is hereby given that it is my
intention to cause all that parcel of
land in the County of Westland, New Zea-
land, situate and fronting on Johnston Street,
Greymouth, being parts of Sections 56 and
57 on the map of the Chief Surveyor of the
Province of Canterbury, setting out and
describing the Town of Greymouth aforesaid,
commencing at a point on the Eastern
boundary of Section 57 seventeen feet from
the South-East corner thereof, thence Nor-
therly along the Eastern boundary of Sec-
tions 57 and 56 a distance of thirty feet, and
extending back Westerly in a rectangular
block sixty-six feet to the Western boundary
of the said sections. To be sold after the
expiration of Three Calendar Months from
this date, unless the above Judgment debts
be sooner paid. And the nature of the
Estate or interest of the Execution Debtor
in such lands intended to be sold is Free-
hold: And further that such lands, or the
Estate or interest of the said Execution
Debtor therein, have been taken in execution
at the suit of the said Execution Creditor.

The time and place fixed for such intended
sale is Monday, the twenty-fourth day
of May, 1869, at 12 o’clock noon, at the
Auction Room of G. W. Binney, of
Wharf Street, at Hokitika, in the County
of Westland; and Gerard George FitzGerald
is the name of the Sheriff under whose
authority such sale is advertised; and the
name and address of the Solicitor for the
Execution Creditor is Arthur Robert Guin-
ess, of Albert Street, Greymouth aforesaid,
whose agent at Hokitika aforesaid is Samuel
Munckly South, Solicitor, Hamilton Street,
Hokitika aforesaid.

Dated this fifteenth day of February,
A.D. 1869.
