Proclamation.

By His Honor William Fitzherbert,
Esquire, C.M.G., Superintendent
of the Province of Wellington, in the Colony of New
Zealand.

WILLIAM FITZHERBERT, Superintendent of the Province of Welling-
ton, by virtue of the powers conferred upon
me by “The Local Boards Act 1873” do
hereby proclaim and appoint that a meet-
ing of persons qualified to vote for “The
Johnsonville District,” under the said Act,
shall be held at the School House, John-
sonville, on Monday, the 21st day of
September, 1874, at 12 o’clock noon, for
the purpose of electing five persons to
constitute the Board of Commissioners
for the said District.

And further, I do hereby appoint
Henry Taylor, the Returning Officer,
at such meeting for the election of Com-
missioners aforesaid.

Given under my hand, and issued
under the Public Seal of the
Province of Wellington, at Wel-
lington, this tenth day of September, one thousand eight
hundred and seventy-four.

Wanganui and Waitotara Highway Board.

Construction Order, No. 7.

The Board having examined the de-
posited plan, section, and specification
for the proposed Oruakainga Road,
and considered the objections and sug-
gestions made respecting such road,
hereby order it to be constructed accord-
ing to the line shown by such plan,
section, and specification.

Wangaehu Highway District.

Bye Law No. 1.

Under the authority of the provisions of
the 18th clause of “The Highway
Boards Empowering Act, 1871.”

  1. It shall be lawful for the Secretary,
    or any other officer of the Wangaehu
    Highway Board, authorized in writing by
    the Chairman of the said Board in that
    behalf, to detain any person or persons
    in charge of or driving any cart, wain, or
    wagon, on or over any of the public roads
    or thoroughfares within the Wangaehu
    Highway District which, in the opinion of
    the Secretary, or other officer so author-
    ized as aforesaid, shall be carrying weights
    in contravention of the provisions of the
    clause proclaimed to be in force under the
    authority of the 84th clause of “The High-

ways Act, 1874,” by a certain proclamation
issued by His Honor the Superintendent
of Wellington, dated the 10th day of
August, 1874; and to require such person
or persons to drive or permit to be
driven, any such cart, wain, or wagon to
the nearest weighbridge, whether in the
Wangaehu Highway District or in the
Town of Wanganui or to such other
convenient place where means may have
been provided for the purpose of having
the weight of the load upon every such
cart, wain, or wagon ascertained; and
any person or persons refusing so to do
or wilfully obstructing the Secretary or
other officer so authorized as aforesaid,
shall be liable to any penalty not exceed-
ing the sum of twenty pounds, to be
recovered in a summary way before one
or more Justices of the Peace; and on
the hearing of any such complaint the
Secretary or other officer may recover all
or any of the penalties prescribed by the
said clause so proclaimed to be in force
as aforesaid; and no person or persons
offending as aforesaid shall be entitled
to plead or maintain on any such hearing
that no proof was given that such cart,
wain, or wagon in his or their charge
was actually carrying a weight in contra-
vention of the provisions of the clause
so proclaimed to be in force as aforesaid,
but it shall be incumbent upon such
person or persons offending as aforesaid
to prove that no breach of the provisions
of the clause so proclaimed to be in force
was committed; and the Secretary or
other officer so authorized as aforesaid
shall for the purposes of this bye-law be
deemed to have been properly constituted
the Agent of the Board upon proof at
the hearing of any complaint as aforesaid
that he was authorized in writing so to
act by the Chairman of the Board: Pro-
vided, that if under the powers aforesaid
the weight upon any such cart, wain, or
wagon should be ascertained as not
exceeding the limit of the weight pre-
scribed under the provisions of the said
clause so proclaimed to be in force as
aforesaid, such secretary or other officer
acting under the powers conferred by
this bye-law shall not be liable for any
loss or damage which may accrue from
any necessary delay in ascertaining such
weight as aforesaid.

I hereby certify that I approve of the
foregoing Bye-law.

NOTICE has been received at this
Office, under the hand of the Chair-
man of the Masterton Highway Board,
that Mr. Duncan Cameron,
of Blair Logie, has been duly Elected a
Warden of No. 4 Ward, Masterton
Highway District, in the place of Mr.
John Moore resigned.
