Special Order.

SPECIAL Order of the Council of the Borough of Wanganui, made under the 301st section of "The Municipal Corporations Act 1867," in pursuance of the power vested in the said Council in that behalf by "The Wanganui Bridge and Wharf Act, 1872."

The Council of the Borough of Wanganui does hereby resolve and ordain as follows: That is to say—

"That the toll in future to be charged for every saddle horse passing and repassing the Toll Gate once each way in the same period of twenty-four hours, reckoning from midnight to midnight, shall be sixpence."

Passed by the Council the fifth day of March, one thousand eight hundred and seventy-three.


Bye-Law No. 2.

BYE LAW of the Council of the Borough of Wanganui made under Special Order of the said Council, dated the fifth day of March one thousand eight hundred and seventy-three, confirmed the third day of April one thousand eight hundred and seventy-three, and sealed with the common seal of the said Borough this fourth day of April one thousand eight hundred and seventy-three:

In pursuance of "The Municipal Corporations Act 1867," and "The Wanganui Bridge and Wharf Act 1872," the Council of the Borough of Wanganui ordain as follows:

That is to say,—

  1. If any person subject to the payment of the Toll authorised to be taken shall neglect or refuse to pay the same the Collector may by himself, or with such assistance as may be necessary, prevent the passage of such person, his cart, horses, cattle, or sheep, until payment of the Toll be made.

  2. If any person shall resist the Collector or other person employed in collecting Tolls, or shall forcibly pass over the said Bridge, or through the Toll Gate or bars without having paid the Toll, or cause any obstruction whatsoever on the Bridge, every such person shall forfeit a sum not exceeding five pounds (£5).

  3. If any person shall wilfully damage or deface the Bridge, Toll Gate, Toll Bars, or any house, fence, or building connected therewith, or any Toll Board, Lamp, or any Furniture, or appurtenances attached to or belonging thereto or connected therewith, he shall forfeit and pay for every such offence a penalty not exceeding five pounds (£5).

  4. Any person riding or driving horses or cattle across the Bridge at a pace faster than a walk shall forfeit and pay a penalty not exceeding two pounds (£2).

  5. If any person shall with intent to avoid payment of Toll make any false representation by word or deed concerning himself or his employer, or concerning any person, vehicle, or animals, or the employment thereof, or shall use any scurrilous, abusive, or threatening language to the Collector or Lessee of the Tolls, or to any person acting for or in the place of such Collector or Lessee, he shall for every such offence forfeit and pay a penalty not exceeding five pounds (£5).

  6. That the Toll in future to be charged for every saddle horse passing and repassing the Toll Gate once each way in the same period of twenty-four hours, reckoned from midnight to midnight, shall be sixpence.

  7. It shall be the duty of the Collector or other person in charge of the Bridge, on ascertaining that the Master or other person in charge of any vessel desires such vessel to pass through the Bridge to cause the Bridge to be opened with as little delay as possible, and to keep the Bridge opened for a reasonable time to allow such vessel to pass through.

  8. It shall be the duty of the Collector, or Lessee, or Farmer of the Tolls, to take all summary proceedings prescribed by any Act or Acts of the General Assembly or the Provincial Council, or by any Bye-law of this Council in any way relating to the Bridge or the Tolls to be taken thereat, and in default of his so doing within a reasonable time after the commission of any act relating as aforesaid he shall be liable to forfeit and pay a penalty not exceeding five pounds (£5).

Provided always that nothing herein contained shall be deemed to preclude any other person acting on behalf of the Borough Council from taking such proceedings as aforesaid.
