Provincial Acts Validation Continuance Act, 1870.

THE following reprint of the above Act is issued for general information.

An Act to continue in operation certain provisions of an Act of the General Assembly validating certain Provincial Acts and Ordinances. [12th September, 1870.]

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows:

  1. The Short Title of this Act shall be “The Provincial Acts Validation Act Continuance Act 1870.”

  2. “The Provincial Acts Validation Act Continuance Act 1869” hereinafter referred to as “the said Act” shall continue in operation until the end of the next Session of the General Assembly and the words “the dissolution of the General Assembly” wherever they occur in the said Act shall be construed and read as meaning the Session of the General Assembly next after the passing of this Act. Provided that the Act set forth in the second part of the Fifth Schedule to “The Provincial Acts Validation Act 1869” be excluded from the operation of this Act and that the Act described in the First Schedule hereto be read as if it formed part of Schedule B to “The Provincial Acts Validation Act Continuance Act 1869.”

  3. Notwithstanding anything to the contrary contained in “The District Highways Act 1867” of the Province of Wellington validated by this Act and until the Provincial Council of Wellington shall otherwise provide the rates which any Highway Board under the said Act may hereafter make shall be annual rates assessed equally upon all rateable property within the district and no rates made by any such Board in any one year shall exceed the amount of one shilling in the pound of the annual value of the property assessed.

  4. The Acts of the Provincial Council of the Province of Hawke’s Bay specified in the Second Schedule hereto shall be deemed from and after the date of the assent of the Governor thereto and until the end of the next Session of the General Assembly to have been and to be valid and to have had and to have such force and effect as if the provisions thereof were contained in an Act of the General Assembly. Provided that the said Acts shall be subject to the provisions of the fourth section of “The Provincial Acts Validation Continuance Act 1869” as continued by this Act.
