Between Wiremu Tako Ngatata and Mere Tako Ngatata,
Plaintiffs, and Manihera te Toru, Defendant.

On Friday, the fifteenth day of November, one thousand eight hundred and sixty-seven.

On reading the affidavit of Mr. Charles Beard Izard, and on hearing Mr. Izard of counsel for the Plaintiffs, and Mr. Buckley of counsel for the Defendant, and by consent it is ordered that the following issues, namely:—

  1. Did the Defendant break and enter the piece of land in the declaration mentioned.

  2. Was the said piece of land at the time of the alleged breaking and entering in the possession of Plaintiffs or of the Defendant.

  3. Was the said piece of land the land of the Plaintiffs or of the Defendant.

Be tried in the Native Land Court at such sitting as shall be appointed by the said Court for the hearing thereof.

Notice is hereby given that the said issues in the above-named action will be heard and determined at Wellington on the 23rd day of June, 1868, and following days.

Huprimi kia whakawakia nga Putake whakawa e toru e mau iho nei e te Kooti whakawa whenua Maori.

  1. I peke ranei a Manihera te Toru ki runga ki te pihi whenua i whakahuatia i taua whakaaturanga.

  2. I te takiwa e kia nei i pekea taua pihi whenua i a wai taua whenua e pupuru ana i a Wiremu Tako Ngatata raua ko Mere Tako Ngatata ranei, na Manihera Te Toru ranei.

  3. He whenua na wai taua pihi whenua na Wiremu Tako Ngatata raua ko Mere Tako Ngatata ranei, na Manihera Te Toru ranei.

Na he Panuitanga tenei kia mohiotia ai, ko nga putake whakawa enei e whakahuatia ki runga ake nei ka whakawakia, whakaotia ki Poneke a te 23 o nga ra o Hune, 1868.
