for the purpose of the said undertaking.
A plan and section of the said under-
taking, with a book of reference thereto, will be
deposited in the Superintendent’s Office,
Taranaki, one month before the com-
mencement of the ensuing Session, on
which plans your property is designated
by the numbers set forth in the annexed
Schedule.

You are requested to state whether you
assent or dissent from the proposed under-
taking, or are neuter in respect thereto, by
filing up the form sent herewith, and re-
turning the same to the Superintendent at
his office at New Plymouth on or before
the day of next; and if
there should be any error or misdescrip-
tion in the annexed Schedule, at the same
time to inform the Superintendent of the
same.

ORDER IN COUNCIL.

At the Government Buildings, at Welli-
gton, this eleventh day of May, 1871.

Present:
The Honourable the Premier, Provl,
and Members of the Executive Council.

WHEREAS by “The New Zealand
Settlements Act, 1863,” it is pro-
vided that after the settlmt subdivision
land for all persons who shall be entitled
thereto under the conditions therein referred
to, it shall be lawful for the Governor in
Council to cause towns to be surveyed and
laid out, and also suburban and rural allot-
ments; and that all such town, suburban,
and rural lands shall be sold, occupied, and
disposed of for such prices, in such manner
and for such purposes, upon such terms
and subject to such regulations, as the
Governor in Council shall from time to
time prescribe for that purpose;

And whereas by “The New Zealand
Settlements Amendment Act, 1865,” it is enacted that the order
and manner in which land taken under the
authority of the said “New Zealand
Settlements Act, 1863,” and “The New
Zealand Settlements Amendment and
Continuance Act, 1865,” should be laid out for sale and
sold, should be at the discretion of the
Governor, who shall have power to cause
such land, or any part thereof, to be laid
out for sale and sold from time to time
in such manner, for such considerations,
and in such allotments as he shall think
fit, and subject to such regulations as he
shall with the advice of the Executive
Council prescribe;

And whereas by “The New Zealand
Settlements Amendment Act, 1866,” it is
provided that the said lands shall be sold
for such consideration or at such price,
and whether for cash or otherwise, as the
Governor shall from time to time pre-
scribe; and that all lands taken under
the authority of the said “New Zealand
Settlements Act, 1863,” and “The New
Zealand Settlements Amendment and
Continuance Act, 1865,” or either of them,
and sold or disposed of under the au-
thority of the said first recited Act, shall
be sold or disposed of under regulations to
be made by the Governor in Council,
with regulations shall be published in the
New Zealand Gazette;

And whereas His Excellency the Go-
vernor did, on the thirteenth day of
April, one thousand eight hundred and
seventy-one, with the advice and consent
of the Executive Council, make regulations
for the sale and disposal of lands in the
West Coast District taken under the said
Acts;

And whereas it is expedient that the
said regulations in the Schedule hereto
should be varied to the Opunake Flax
Company, Limited, at and for the price of
three pounds per acre;

Now therefore His Excellency the
Governor, in exercise and pursuance of all
powers and authorities enabling him in
that behalf, and with the advice and con-
sent of the Executive Council of New
Zealand, doth hereby order that the land
described in the Schedule hereto, shall
be sold to the Opunake Flax Com-
pany, Limited, at and for the price of
three pounds per acre, and that John
Stephenson Smith, Esq., Commissioner of
Crown Lands for the Province of Taranaki,
shall and may conduct the said sale.
