buildings, that a formal application shall first be made to the Superintendent to ascertain if it would interfere with the construction of any public work contemplated by the Provincial Government.

  1. That the Company shall have the right to make ample enclosures for the purpose of erecting buildings, machinery, making reservoirs, or for any other purpose necessary for the successful promotion of the work, subject to the conditions herein named, and also to make use of any stone, or other material on or in the ground, which will be necessary to carry on their operations.

  2. That it shall be in the power of the Superintendent, with the approval of the Provincial Council, expressed by resolution to that effect, to determine and cancel the rights granted to the Company if they are not expending in the province in carrying on the works the sum of £500 per annum.

  3. That the Government shall have power, by any person whom they may appoint, to inspect the books and works of the Company, with a view to obtain any information which may be desirable in connection with the foregoing conditions.

SALE OF PETROLEUM LICENSES.

New Plymouth, June 9, 1866.

MESSRS. WATTY & CO. having received instructions from the Provincial Government, sold on the 9th June, 1866, the right to sink for Petroleum on the lands herein named, subject to the following conditions, to the undermentioned persons, viz. :

Mr. Hulke, for Mr. Hoytz, lot No. 1 £105
Mr. Carter, lot No. 2 ............... 100
" " 3 ............... 60

Description of Land.

Lot No. 1.—All that portion of land between the Native Reserve No. 1 and high water, 100 feet wide, containing 2 acres 3 roods 30 perches, more or less, and coloured purple on the accompanying map.

Lot No. 2.—All that portion of land between the western half of the mission station and high water, 100 feet wide, containing 2 acres 1 rood 20 perches, more or less, and coloured yellow on the accompanying map.

Lot No. 3.—All that portion of land between the eastern half of the mission station and high water, 100 feet wide, containing 2 acres 1 rood 30 perches, and coloured pink on the accompanying map.

Conditions of Sale.

The highest bidder for the right to sink on each lot shall be declared the purchaser, subject as follows :-

  1. 10 per cent. of the purchase money to be paid at the time of sale, the balance within one week or the deposit shall be forfeited.

  2. The purchaser shall engage to commence operations for sinking within six months of the date of purchase.

  3. The purchaser shall undertake to sink to the depth of 400 feet within two years from the date of sale, or expend the sum of £500 for that purpose if the Petroleum is not obtained at a less depth, or by a less expenditure.

  4. The purchaser to be subject to the conditions imposed on the Taranaki and People’s Petroleum Companies, in regard to the right of the Government to enter on the lands for public purposes.

  5. The royalty to be paid to the Government shall be 10 per cent. on all the Petroleum obtained, the said Petroleum to be delivered in tight packages fit for exportation.

  6. In the event of the above conditions, or any of them, not being complied with, the lease shall be cancelled, and all money paid by the lessee forfeited as a penalty for nonfulfilment of contract.

  7. The Government undertakes to give a lease of the right to sink for Petroleum in the lands before described, when the Crown grant promised by the Colonial Government is received, but will not hold themselves responsible for any loss the purchaser may sustain in consequence of the grant being withheld by the Colonial Government, farther than the return of the purchase money.
