Assent of Natives to certain Reserves under "Native Reserves Act, 1856."

At the Government House, at Wellington, on the nineteenth day of November, 1865.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an Act of the General Assembly of New Zealand, intituled "The Native Reserves Amendment Act, 1862," it is amongst other things provided that where, under the provisions of "The Native Reserves Act, 1856," the assent of the aboriginal inhabitants is required to bringing land under the operation of the said "Native Reserves Act, 1856," the Governor may by Order in Council, declare such assent to have been ascertained, and thereupon the title of the aboriginal inhabitants in the land to which the same shall relate shall be deemed to be extinguished, and the land shall, from the date of such Order in Council, vest in her Majesty for the purposes and subject to the provisions of the said "Native Reserves Act, 1856," as altered by the recited Act, and that as effectually as if the same had been ceded and conveyed by such aboriginal inhabitants to her Majesty:

Now, therefore, His Excellency the Governor by and with the advice and consent of the Executive Council, doth hereby declare that the assent of the aboriginal inhabitants to the bringing the pieces of land described in Schedules A and B hereunder written under the operation of "The Native Reserves Act, 1856," has been ascertained.

Regulations for the Management of Quarantine Ground

Proclaim and declare the following Regulations to be in force for landing and driving cattle imported from districts where infectious disease is known to prevail, and for the management of the quarantine ground, and for fixing the fees and charges thereof, and the conditions upon which cattle may, in certain cases, be removed therefrom within the full period of fourteen days from their first entering:—

  1. No cattle imported from a district which has been declared infected shall be landed unless a certificate or other sufficient proof shall have been produced to the Inspector that they were clean when shipped.

  2. Upon the production of such certificate or other proof the Inspector shall examine the cattle on board, and proceed as directed by clause IV. Sections (c) and (d) of the Act.

  3. The fee for the use of the quarantine ground shall be two shillings per head.

  4. Cattle shall remain in the quarantine ground for a period of not less than forty-eight hours, nor more than fourteen days, and shall whilst there be fed at the expense of their owners.

  5. Any person removing, or causing to be removed, any cattle from the quarantine ground, without permission from the Inspector, shall be subject to a penalty not exceeding fifty pounds for every head of cattle so removed.

  6. On the recommendation of the Inspector, and on a certificate from him (to be called a Removal Certificate) that any cattle in the quarantine ground are free from all visible symptoms of infectious disease, and that a suitable enclosure, to receive them, the Superintendent may at any time after the expiration of forty-eight hours from their first entering, allow such cattle to be removed to such enclosure, there to remain for the period of one calendar month from the date of such removal; and if any such cattle shall be found during the said period of one month elsewhere than in the said enclosure, unless permission in writing shall have been given by the Inspector to remove them to some other place, the owner thereof shall be subject to a penalty not exceeding five pounds per head for every head of cattle so found.

  7. These regulations shall take effect from and after the fifteenth day of December, 1865.

SCHEDULE A.

All that parcel of land in the Province of Taranaki, Colony of New Zealand, containing by admeasurement one hundred acres, more or less, being part of Native Reserve marked B on the plan of the Waikakaiho District, bounded towards the north by wasteland and Native Reserve marked A, two thousand and twenty links; towards the east by wasteland, five thousand seven hundred links; towards the south by allotment numbered two hundred and four, two thousand and twenty links; and towards the west by the Smart Road, five thousand one hundred links.
