VIII. Any stock not being the property of, or which are not branded with the registered brand of the holder of license under which they are depastured, or which are depastured on the Hundred in contravention of any bye-law duly passed, may be impounded, and the owner or custodian of such stock may be proceeded against for trespass, and shall forfeit and pay any sum not exceeding five pounds.
IX. That any person intending to travel with or drive cattle through the said Hundred into any adjoining Hundred, freehold or leasehold, shall give not less than twenty-four hours’ notice in writing stating the number, brands, and other particulars of such stock to the nearest Warden, who upon being satisfied that such stock are free from disease, shall give a written authority to the owner or party in charge of such stock for driving through the said Hundred: provided always that cattle of bona fide travellers on their journey, when turned out, be not considered trespassers, if not more than three nights in the same neighbourhood; failing to do so shall forfeit and pay for every such offence a sum not exceeding five pounds.
X. That any sheep running upon the Crown Lands in the said Hundred shall be removed within twenty-eight days of publication of the said bye-laws; also any cattle not being the property of an occupier, whether freeholder or leaseholder, shall, if not removed within the same period, be impounded and dealt with according to law.
XI. That one horse shall be considered equivalent to three head of horned cattle.
XII. That trespassing cattle shall be seen three different days on the Hundred before they are impounded.
XIII. That any license holder depasturing cattle on the said Hundred, upon being called on by the Wardens, shall give them a correct return of such cattle, with their brands and number, and neglecting to do so shall forfeit and pay for every such offence any sum not exceeding five pounds.
All or any of the Acts authorised by these bye-laws may be enforced by any two of the Wardens or other person duly appointed or authorised in that behalf: provided always that nothing contained in the above bye-laws shall be held or construed to authorise the impounding of any sheep or cattle which are being depastured on any land, whether fenced or not, which is the property of, or is lawfully occupied by the owner of such sheep or cattle.
