If Superintendent-appointment at within or before the prescribed time it shall be lawful for the Governor if he shall dent fails or proposes to do such act matter or thing or make any such appointment to extend or alter the appointment time for doing such act matter or things or making such appointment and if necessary to extend etc. Governor or alter the time for doing any other acts matters or things which under the provisions nor may on herebefore contained are consequent or in any manner depend on the act matter or thing or petition of appointment which the Superintendent shall have failed or neglected to do or make at the prescribed time.
Governorβs proclamation etc.
- Where by this Act it is provided that any proclamation order notice appointment or other matter or thing made or done by the Governor shall be published or notified in the New Zealand Gazette such publication or notification shall be in the New Zealand Gazette and where by this Act it is provided that any proclamation order notice appointment or other matter or thing made or done by a Superintendent of a province shall be published or notified in the Gazette such publication or notification shall be in the Government Gazette of such province.
Right of making roads etc.
- Notwithstanding anything herein contained it shall be lawful for the Governor or the Superintendent to cause to be made constructed maintained and repaired within any borough or reserved to such roads and bridges as he shall think fit and also to cause to be constructed in or through any borough any railway canal or any other work whatsoever which shall be authorised by law and for all such purposes as aforesaid such persons as the Superintendent shall appoint shall have all the powers which are hereby vested in the council of such borough in the like behalf for the construction maintenance or repair of roads or bridges or for the execution of any permanent work or undertaking.
Certain roads etc.
- Nothing herein shall authorise the interference by any council with any public road exempted railway bridge ferry cemetery market wharf aqueduct public place or building whatsoever not from control formed constructed or erected by such council which may be excepted from the jurisdiction of such council by any proclamation made or to be made by the Superintendent or respecting which special provision shall have been or shall be made by any Act of the General Assembly or of any provincial Legislature. Provided that the Superintendent may by proclamation authorise the council to take upon itself the charge of any such excepted public road railway bridge ferry cemetery market wharf aqueduct public place or building within the limits of the borough and in actual use by the people of such borough upon such conditions as shall be specified in such proclamation with reference to the amount of compensation to be paid by the council.
Fines etc.
- All fines and penalties paid or recovered under any of the provisions of this Act or of any bye-law made or adopted hereunder shall be paid over by the clerk or other proper officer to be paid of the court in which the same shall have been recovered to the council of the borough within which the offence or breach for which such fines or penalties shall be imposed shall have been committed and all fines and penalties paid or recovered under this Act or any borough bye-laws as aforesaid for any act matter or thing done within or with respect to any borough or for any omission or neglect to do any act matter or thing which ought under the provisions of this Act or any such bye-laws as aforesaid to have been done within or with respect to any borough shall be paid to the council of such borough and all such fines and penalties as aforesaid shall when received form part of the borough fund.
Superintendent may extend Act to cities etc.
- It shall be lawful for the Superintendent of any province by proclamation published in the Government Gazette of such province to declare that any complete parts of the several clauses of this Act numbered two to twenty-two inclusive as he shall consider applicable shall extend and be applied to any city town or place in such province incorporated at the time of the passing of this Act under any Act of Ordinance of the Legislature of such province and in such proclamation to fix a time at which such parts or any of them shall extend to any such city town or place but no such proclamation shall be valid or have any force which affects to proclaim any provisions contained in any part without the remainder of the provisions of such part.
