PROCLAMATION

Appointing certain Roads in the Myross and Mabel Sub-Divisions of the Lyndhurst Road District to be Main District Roads.

By His Honor James Macandrew, Esquire, Superintendent of the Province of Otago.

WHEREAS by the “Otago Roads Ordinance 1871,” it is provided that upon the application of the road Board of any road district, the Superintendent may from time to time, if it shall seem fit so to do, by proclamation, appoint that any roads or parts of roads, whether within or upon the boundary of such district, shall be main roads or main district roads: And whereas the road Board for the Makarewa road district have applied to me, James Macandrew, Superintendent of the Province of Otago, to appoint the roads hereinafter described, to be main district roads:

Now therefore I, James Macandrew, Superintendent of the Province of Otago, by virtue and in exercise of the powers in this behalf vested in me by the said “Otago Roads Ordinance 1871,” do hereby appoint the following roads, situate within or upon the boundary of the Makarewa road district aforesaid, to be main district roads, that is to say:—

  1. The road line running westerly through Weyms street, Winton, and terminating at the south-west corner of section 14, block VI, Winton Hundred.

  2. The road line commencing at the main north road and running in an easterly direction on the southern boundary of the Winton township; thence through the bush along the dividing line between blocks II and III, Winton Hundred, to the south-west corner of section 17, block III, aforesaid; thence along the south-western boundaries of sections 17, 18, 19, and the northern boundary of 30, block III aforesaid, to the eastern boundary of the Winton Hundred.

  3. The road line leading in a north-easterly direction through Ryal Bush, leaving the main north road at section 4, block I, and terminating at section 18, block III, in the New River Hundred.

  4. The road line commencing on the north road, at the north-west corner of section 16, block II, running through Ryal Bush due east and terminating at section 8, block IV, New River Hundred.

  5. The road line meeting the main north road at the north-west corner of section 10, block XIV, Invercargill Hundred, and running due south for a length of one hundred and forty chains.

  6. The road line meeting the main north road at the north-east corner of section 2, block XIV, Invercargill Hundred, and running due west for a length of seventy-six chains.

  7. The road line meeting the main north road at the south-east corner of section 1, block XIV, Invercargill Hundred, and running due west for a length of two hundred and sixty chains.

  8. The road line meeting the main north road at the north-west corner of section 14, block IV, Invercargill Hundred, and running due east for a length of one hundred and twenty chains.

Given under my hand, and issued under the public seal of the Province of Otago, at Dunedin, this tenth day of February, one thousand eight hundred and seventy-three.

NOTICE FOR DISTRICT ROAD BOARDS.

Dunedin, 11th February, 1873.

ANY District Road Board requiring a road or roads to be taken through private property under the powers conferred on the Government by the “Provincial Compulsory Lands Taking Act 1866,” must forward to this office plans and descriptions of such road or roads by an authorized surveyor, in sufficient time to enable the standing Rules and Orders of the Provincial Council of Otago under the Act above-mentioned to be complied with.

The clause of the standing Rules and Orders is published below for general information.

Notice of intention to introduce Bill to be gazetted thirty days before Session, and fourteen days’ notice to be given to owner, &c.

  1. Not less than thirty days previous to the commencement of the Session in which any Bill shall be introduced under the provisions of the “Provincial Compulsory Land Taking Act 1866” (hereinafter referred to as the said Act), a notice shall be published in the New Zealand Government Gazette and also in the Government Gazette of the Province, setting forth the objects, and stating the intention to introduce such a Bill; and, also, stating the time at which a copy of the Bill may be inspected at the office of the Clerk of the Provincial Council; and such notice shall contain the name of the township, district, or other territorial division in which the lands intended to be taken are situated, and the blocks and sections or parts of sections to be so taken; and not less than fourteen days previous to the commencement of the Session a notice in the form or to the effect set forth in the Appendix marked B shall be given to the owners, or reputed owners, lessees, or reputed lessees, and occupiers of all lands intended to be taken for the purposes of the Bill, either by delivering a copy of such notice personally to every such person, or by leaving the same at his or her place or last known place of abode in the Province; or, in case of his or her absence from the Colony, with his or her agent, or by forwarding the same by post in a registered letter, addressed with a sufficient direction to his or her last known place of abode in the Province; or, if his or her absence from the Colony, with his or her agent, or by forwarding the same by post in a registered letter, addressed with a sufficient direction to his or her last known place of abode in the Province.
