  1. All unbranded cattle above six months of age depasturing on the Crown Lands within a Hundred shall be liable to be impounded, in manner provided by section 13 of the Otago Waste Lands Acts 1866 Amendment Act 1869.

  2. Any cattle found depasturing on a Hundred, not being the property of, or in the custody of a license-holder, or depasturing on the Hundred in contravention of these Regulations, may be impounded; and the owner or custodian of such cattle shall forfeit and pay for every such offence the sum of £5, to be recovered in a summary way.

  3. Any person disturbing or harassing cattle, great or small, depastured within any Hundred, shall be liable to a penalty of £5, to be recovered in a summary way: provided always that any person holding a license to depasture cattle within the Hundred, or any person duly authorised by him, may drive cattle so depastured for the purpose of collecting such of them as may belong to him, and for the legitimate use of the right to pasture within the Hundred; but in case it should be necessary for such purpose to drive any cattle belonging to any other person a greater distance than one mile, the person so driving such cattle must take them to the nearest stock-yard, and there separate his own cattle from those of other persons, and return the latter to the place from whence they were driven.

  4. No person shall remove cattle from beyond the boundary of any Hundred other than those belonging to him, or for the removal of which he shall have due authority, under a penalty of £20, to be recovered in a summary way.

  5. Any person shooting cattle on any Hundred without the consent in writing of the Waste Land Board previously obtained, shall be liable to a penalty of £20, to be recovered in a summary way.

  6. Any person who shall set fire to any herbage or grass upon the Crown Lands within any Hundred without the consent in writing of the Chief Commissioner of the Waste Land Board previously obtained, shall forfeit and pay for every such offence the sum of £5, to be recovered in a summary way: but such consent will not protect any person from the consequences of any loss or damage which may be sustained by any person by reason of the carelessness with which such burning of the Hundred may be performed.

  7. The Waste Land Board may appoint one or more Rangers for each Hundred, whose duty shall be to see that these Regulations are carried into effect, and to report any neglect or breach thereof to the Waste Land Board.

  8. The word cattle in these Regulations shall mean all animals included within the meanings attached to great and small cattle by the “Otago Waste Lands Act 1866,” and shall include, except where the context clearly shows a contrary intention, a single head of great or small cattle, as well as any larger number.

  9. The number of cattle placed under the name of each Hundred in the first column of the Statement hereunder written, shall be the quantity of cattle capable of being depastured on the Waste Land within such Hundred for the year 1871.

  10. The number of cattle specified in the column of the said Statement headed “Total Cattle Allowed to be Depastured,” opposite the names of the several persons to whom licenses have been issued, or who are entitled to have licenses issued to them in each Hundred, shall be the number of cattle which may be depastured for the year 1871 by the persons respectively whose names are specified in the second column of the said Statement, on such persons respectively paying the assessment mentioned in the Act.

  11. Five sheep may run instead of every head of great cattle.

  12. Any license-holder who, prior to the 1st day of June next, shall not have depastured on the Hundred the full quantity of the stock he is entitled to depasture, may, at any time before that date, place such number of stock thereon as (together with the quantity previously depastured by him, if any,) will make the total quantity depastured by him equal to that in the column of the said Statement headed “Total Cattle Allowed to be Depastured,” apportioned to him: provided that within three days after such additional stock shall have been placed on the Hundred, a return shall be forwarded to the Waste Land Board, showing the number, description, and brands of such additional stock.

  13. Any license-holder may be required by the Ranger at any time to make a return in the form provided in the Schedule to these Regulations, made by the Waste Land Board, and published in the Provincial Government Gazette of the 19th day of January last past; and any person who shall fail to make such return for a period of 24 hours after being required so to do, or who shall make a false return, shall be liable to a penalty of £20.

  14. An assessment of 3s. 6d. for great cattle, and 7d. for small, will be payable to the Provincial Treasury, at his office in Dunedin, on or before the first day of June next, for all cattle depastured on the Waste Lands within any Hundred.
