PROVINCE OF OTAGO

His Honor James Macandrew, Superintendent of the Province of Otago, by and with the advice and consent of the Executive Council of the said Province, doth by virtue and in exercise of the powers delegated to the Executive Government of the said Province in this behalf by His Excellency the Governor of New Zealand in Council, under the authority of "The Gold Fields Act Amendment Act 1867," by a delegation dated the fourteenth day of December, one thousand eight hundred and seventy, and of any and every other power in anywise enabling the said Executive Government in this behalf, hereby order, proclaim and declare that the provisions of the said Order in Council of the twenty-eighth day of January, one thousand eight hundred and seventy, shall extend to and be in force within the said Orepuki and Longwood Gold Field, the said Bushy Point Gold Field, and the said Campbell Town Gold Field, and doth hereby proclaim and declare that from and after the day of the date hereof the exceptions in the said Order in Council appearing and relating to Agricultural Leases shall be made from, and the covenants, clauses, provisos, conditions and agreements in the said Order in Council appearing and relating to such leases, shall be applicable to all Agricultural Leases granted under the said "Gold Fields Act 1866," within the said Gold Fields respectively, and that the exceptions in the said Order in Council appearing and relating to gold mining leases shall be made from, and the covenants, clauses, provisos, conditions and agreements in the said Order in Council appearing and relating to such leases, shall be applicable to all gold mining leases granted under the said Act within the said Gold Fields respectively.

PROCLAMATION

Of His Excellency the Governor having assented to certain Ordinances of the Superintendent and Provincial Council of the Province of Otago.

By His Honor James Macandrew, Superintendent of the Province of Otago.

WHEREAS in the Twenty-eighth Session of the Provincial Council of the Province of Otago the Bills next hereinafter mentioned were passed by the said Council (that is to say):—

The "Port Chalmers Reserves Management Ordinance 1870,"

The "Invercargill Park Reserves Management and Leasing Ordinance 1870,"

The "Racecourse Reserves Leasing Ordinance 1870,"

The "Otago Representation Ordinance (No. 2) 1870."

And whereas the said Bills were severally presented to the Superintendent of the Province of Otago for the assent of His Excellency the Governor of New Zealand thereto, and the said Superintendent did upon the said several Bills being so presented to him as aforesaid, declare that he reserved:

The "Port Chalmers Reserves Management Ordinance 1870,"

The "Invercargill Park Reserves Management and Leasing Ordinance 1870,"

The "Racecourse Reserves Leasing Ordinance 1870,"

for the signification of the Governor's pleasure thereon; and that he the said Superintendent assented to the said Bill intituled The "Otago Representation Ordinance (No. 2) 1870."

The "Otago Representation Ordinance (No. 2) 1870" on behalf of His Excellency the Governor of New Zealand, instead of reserving the same for the signification of the Governor's pleasure thereon, and the said assent so given by the said Superintendent being a nullity, His Excellency the Governor of New Zealand is empowered under the provisions of the Act of the General Assembly of New Zealand shortly intituled "The Provincial Reserved Bills Act 1870" to signify his pleasure on such Bill in the same manner as if the same had been reserved for the signification of his pleasure thereon instead of being assented to: And whereas the said several Bills have since been laid before His Excellency the Governor of New Zealand, and he has been pleased to assent to the same.

Now therefore I, James Macandrew, Superintendent of the Province of Otago, do hereby proclaim and declare that the said several Bills before mentioned (that is to say):

The "Port Chalmers Reserves Management Ordinance 1870,"

The "Invercargill Park Reserves Management and Leasing Ordinance 1870,"

The "Racecourse Reserves Leasing Ordinance 1870,"

The "Otago Representation Ordinance (No. 2) 1870,"

have been laid before His Excellency the Governor of New Zealand, and that His Excellency has assented to the same.

Given under my hand, and issued under the Public Seal of the Province of Otago, at Dunedin, in the said Province, this eleventh day of February, one thousand eight hundred and seventy-one.
