the twenty-ninth day of January one thousand eight
\n hundred and sixty-seven constitute and appoint all the territory
herein described (including amongst other lands the
\n lands undescribed in the Schedule hereto) to be a Gold Field
\n under the provisions of the "Gold Fields Act 1866" to
\n be called the "Otago Gold Field". And whereas by the
\n "Gold Fields Act Amendment Act 1867" it is enacted
\n that within any Province in which by any Act or Ordinance it is provided that the Superintendent shall in the
\n administration of the government thereof act by and with
\n the advice and consent of an Executive Council it shall
\n be lawful for the Governor in Council under his hand
\n and under the Public Seal of the Colony from time to
\n time as occasion may require to delegate to the Executive
\n Government for the time being of such Province
\n subject or not to any restrictions or limitations as he
\n shall think fit all or any of such powers vested in the
\n Governor or the Governor in Council by the "Gold
\n Fields Act 1866" as under or by virtue of the one hun-
\n dred and ninth section of the said Act may be delegated
\n by the Governor in Council and in like manner to revoke
\n any such delegation: And whereas by an Ordinance of
\n the Superintendent and Provincial Council of the Pro-
\n vince of Otago intituled the "Executive Council Ordi-
\n nance 1861", it is provided that the Superintendent of
\n the said Province shall in the administration of the
\n government thereof act by and with the advice and
\n consent of an Executive Council: And whereas the
\n Governor hath with the advice and consent of the
\n Executive Council of New Zealand and in pursuance
\n of the power and authority for that purpose vested in
\n him by the "Gold Fields Act 1866" and subject to
\n its provisions delegated unto the Executive Govern-
\n ment for the time being of the Province of Otago all
\n such powers vested in the Governor or the Governor in
\n Council by the said last mentioned Act as under or by
\n virtue of the one hundred and ninth section of the said
\n last mentioned Act may be delegated by the Governor
\n in Council to have hold and exercise the said powers
\n within the said Province of Otago: And whereas it is
\n by Clause thirty-nine of the "Gold Fields Act 1866" it is
\n provided that if at the date of the passing of the said Act have
\n been granted or shall have been or shall be cancelled
\n over any Crown Lands within a Gold Field it shall be
\n lawful for the Governor from time to time by proclama-
\n tion to declare such lands or any part thereof open
\n for sale or selection in sections of such size and form
\n as he may determine and any lands so proclaimed may
\n thereafter be sold, at a like price and subject to the like
\n terms and conditions or as near thereto as may be
\n as Crown Lands of the same class not within a
\n Gold Field and it shall not be necessary to withdraw
\n lands from the operation of the said Act for the pur-
\n poses aforesaid: And whereas at the date of the passing
\n of the "Gold Fields Act 1866" all Depasturing
\n Licences hitherto existing over the Crown Lands
\n specified in the Schedule hereto have been cancelled:
\n And whereas the Executive Government of the Province
\n of Otago have determined to open up for sale the said
\n Crown Lands specified in the Schedule hereto in
\n sections of the size and form in which the same have
\n already been surveyed and as the same are now laid off
\n and delineated in the maps of the Chief Surveyor of
\n the Province of Otago relative thereto: Now therefore
\n His Honor James Macandrew, Superintendent of the
\n Province of Otago by and with the advice and consent
\n of the Executive Council of the said Province doth
\n hereby by virtue and in exercise of the powers dele-
\n gated to the Executive Government of the said Pro-
\n vince in this behalf by His Excellency the Governor
\n of New Zealand in Council under the authority of the
\n "Gold Fields Act Amendment Act 1867" and of every
\n other power in anywise enabling the said Executive
\n Government in this behalf proclaim and declare that from and after the day of the date hereof

\n the Crown Lands specified in the Schedule hereto shall
\n be open for sale in sections of the size and form
\n in which such lands have already been surveyed and as
\n the same are now laid off and delineated on the maps
\n in the Office of the Chief Surveyor of the Province of
\n Otago relative thereto.

\n THE SCHEDULE ABOVE REFERRED TO:

\n All that area situate in the Province of Otago con-
\n taining by estimation two thousand acres more or less
\n being part of Run numbered 345 on the map of the
\n interior pastoral districts and now known as block XII
\n Coneburn District: bounded towards the north by
\n Kawarau River fourteen thousand nine hundred (14,900)
\n links towards the east by blocks II and IV Coneburn
\n Survey District twenty-seven thousand three hundred
\n (27,390) links towards the south by block III Coneburn
\n District aforesaid ten thousand (10,000) links and to-
\n wards the west by block I Coneburn District aforesaid
\n twenty thousand five hundred (20,500) links.

\n AGRICULTURAL LEASES REGULATIONS.

\n ORDER IN COUNCIL.

\n At the Provincial Government Buildings, Dunedin
\n the twenty-eighth day of October, one thousand
\n eight hundred and seventy.

\n Present:
\n His Honor the Superintendent,
\n Donald Reid, and
\n George Duncan, Esquires,
\n Members of the Executive Council of the Province of
\n Otago, being also Members of the Provincial
\n Council of the said Province.

\n WHEREAS by the 89th section of "The Gold
\n Fields Act 1866" it is provided that it shall
\n be lawful for the Governor from time to time to make
\n regulations prescribing the mode in which applications
\n may be made for leases of land for agricultural purposes
\n the quantity of land not exceeding fifty acres which
\n shall and may be granted in a lease in any particular
\n block the amount of deposit to be paid by any applicant
\n therefor and by any objector thereto the terms and
\n conditions upon which such leases may be held occupied
\n assigned transferred forfeited and cancelled the amount
\n of rent payable therefor and the times and places of
\n payment the conditions upon and the manner in which
\n entry to search for gold or for any metal or mineral
\n upon any land so leased may be authorised and the
\n terms and conditions upon which holders of Miners'
\n Rights may be permitted to mine upon land the lease
\n for which shall have been determined on account of its
\n auriferous character and such regulations from time to
\n time amend alter and revoke: And whereas by the "Gold
\n Fields Act Amendment Act 1867" it is enacted that within
\n any Province in which by any Act or Ordinance it is
