✨ Provincial Land and Depasturing Orders
the twenty-second day of March, one thousand eight hundred and sixty-seven: And whereas the Executive Government of the Province of Otago have determined to cancel the said lease as to so much and such part of the lands held under the same as are comprised within the area hereinafter described:
Now, therefore, I, James Macandrew, Superintendent of the Province of Otago, by and with the advice and consent of the Executive Council of the said Province, and by virtue and in exercise of the powers delegated to the Executive Government of the said Province in this behalf by His Excellency the Governor of New Zealand in Council; under the authority of the “Gold Fields Act Amendment Act 1867,” and of any and every other power in anywise enabling me in this behalf, do hereby cancel the said lease, in so far as the lands comprised within the area hereinafter described are affected by the said lease, but no further or otherwise (that is to say):—
All that area in the Province of Otago, containing by admeasurement three (3) acres, more or less, situate on Run No. 221, and being Section numbered seventy one (71), Block one (I), Leaning Rock District—bounded towards the north-west by Crown Lands, three hundred and ninety-one (391) links; towards the north-east by Crown Lands, seven hundred and sixty-eight (768) links; towards the south-east by Crown Lands, three hundred and ninety-one (391) links; and towards the south-west by a road line, seven hundred and sixty-eight (768) links.
Given under my hand and issued under the Public Seal of the Province of Otago, at Dunedin, in presence of Donald Reid, and George Duncan, Esquires, members of the Executive Council of the said Province, being also members of the Provincial Council thereof, this sixteenth day of September, one thousand eight hundred and seventy.

ORDER IN COUNCIL.
At the Provincial Government Buildings, Dunedin,
the twentieth day of September, one thousand eight hundred and seventy.

WHEREAS by Proclamation bearing date the 23rd day of June, 1868, made by the Superintendent of the Province of Otago, with the advice and consent of the Executive Council of the said Province, and published in the Otago Provincial Government Gazette, No. 553, under the hand of the said Superintendent of the Province of Otago, and under the Public Seal of the said Province, certain regulations were made for the depasturing of Stock upon the Waste Lands of the Crown, within the Otago Gold Field: And whereas by an Order in Council, bearing date the 6th day of October, 1868, published in the said Otago Provincial Government Gazette, No. 574, the said Superintendent, with the advice and consent of the said Executive Council of the said Province, did thereby revoke certain of the said regulations so made and published on the said 23rd day of June then last as aforesaid, and did make the regulations therein contained in lieu thereof: And whereas by an Order in Council, bearing date the 7th day of November, 1868, published in the said Otago Provincial Government Gazette, No. 578, the said Superintendent, with the advice and consent of the said Executive Council of the said Province, did thereby revoke Regulation No. 22, so made by the said Order in Council, of the 6th day of October then last past, and did make the regulations therein contained in lieu thereof, and in addition to the regulations so made and published as aforesaid: And whereas by an Order in Council, bearing date the 11th day of September, 1869, and published in the said Otago Provincial Government Gazette, No. 628, the said Superintendent, with the advice and consent of the said Executive Council, did thereby revoke Regulation No. 24 so made by the said Order in Council of the 7th day of November, 1868, and did make the regulation therein contained in lieu thereof: And whereas it is expedient to revoke Regulation No. 4, published in the said Otago Provincial Government Gazette of the 23rd day of June, 1868, and also the said Regulation No. 24, published in the said Otago Provincial Government Gazette of the 11th day of September, 1869, and to make other regulations in lieu thereof:
Now, therefore, His Honor James Macandrew, Superintendent of the Province of Otago, with the advice and consent of the Executive Council of the said Province of Otago, doth, by virtue and in exercise of the powers delegated to the Executive Government of the Province of Otago in this behalf, hereby revoke the Regulation No. 4, so made by the said Proclamation of the twenty-third day of June, one thousand eight hundred and sixty-eight as aforesaid, and also the said regulation No. 24, so made by the said Order in Council of the eleventh day of September, one thousand eight hundred and sixty-nine as aforesaid, and doth make the following regulations in lieu thereof (that is to say):—
Depasturing regulations.—Otago Gold Field.

The Wardens for each Depasturing district shall be elected annually on the first day of August in each year, or upon such other day as the Superintendent shall by notice in the Otago Provincial Government Gazette from time to time direct.

Mr. John Mackay, the Inspector of the Gold Field Depasturing Districts, shall be and he is hereby authorised to receive applications for the depasturing of stock within the Tuapeka Depasturing District, described in the schedule to the said Proclamation of the twenty-third day of June, one thousand eight hundred and sixty-eight, and in the schedule to the said Order in Council of the seventh day of November, one thousand eight hundred and sixty-eight, until a Board of Wardens shall be duly elected for the said district.
