Severn to Tees-street, which will make a shorter road
into the south-east portion of the town than going round
by Severn-street. A portion of the Esplanade has been
cleared of flax, preparatory to the plantation of plots of
trees, &c., which will assist in ornamenting the town.
Several temporary drains have been made to carry off
storm water, &c. Lamps have been erected in the most
requisite places. A pound has also been put up. It is
also the intention of the Council to establish a complete
system of drainage, and to afford assistance to the establishment of a fire brigade. A weighbridge is also
being erected.
I have the honor to be, Sir, your most obedient servant,
James Dougherty, Clerk General Road Board
MOKORETA HUNDRED.—Bye-laws passed at a
meeting of the Wardens, 12th March, 1867.
-
No diseased cattle shall be placed upon the Hundred to be depastured thereon.
-
No cattle from any diseased district, or which
shall have been driven through any diseased district,
shall be put upon the Hundred until the owner or person in charge of the same shall have produced to the
Wardens a certificate from a duly qualified Inspector to
the effect that such cattle are free from the disease
called Pleuro-pneumonia, and satisfactory evidence that
they have been free from that disease during the preceding six months. -
No entire animal over the age of six months shall
be depastured upon the Hundred without the consent
in writing of the Wardens, or a majority of them. -
If it shall appear to the Wardens, or a majority of
them, that any animal of a dangerous or vicious character is depastured upon the Hundred, and if upon giving
notice to that effect to the owner or person in charge of
the same, either by delivering such notice personally, or
by leaving the same at his usual place of residence, such
owner or person in charge of such animal shall not
remove such animal within forty-eight hours after the
delivery of such notice, it shall be lawful for the Wardens to impound such animal, to be dealt with according
to law. -
Any unbranded cattle over the age of six months
may be impounded to be dealt with according to law. -
Every person depasturing cattle upon the unfenced
pasture lands within the Hundred, shall furnish the
Wardens with a return showing the number, sex, description, and brands of all and every beast depastured
by him thereon, or failing to make such return as aforesaid within two days after placing such beast upon the
Hundred, or at any subsequent time, within seven days
after receiving notice so to do from the Wardens, or
making a false return, shall be liable to the penalty
hereinafter provided. -
Any cattle not being the property, or in the custody of a license holder, or being the property or in the
custody of a license holder, but depastured on the Hundred in contravention of any bye-laws duly passed, may
be impounded, to be dealt with according to law, and
the owner or custodian thereof shall be held to be liable
to a penalty for trespass. -
No person shall set fire to the herbage or grass
upon the Crown Lands within the Hundred, without
the consent in writing of the majority of the Wardens. -
No person shall disturb or harass cattle lawfully
depasturing upon the Hundred, provided always that
any person holding a license to depasture cattle within
the Hundred, or any person duly authorised by him may
drive such cattle for the purpose of collecting such as
may belong to him, and for the legitimate use of his
right of pasturage within the Hundred, but in case it
should be necessary for such purpose to drive any cattle belonging to any other person a greater distance than
half-a-mile, the person so driving such cattle must take
them to the nearest available stockyard, and there separate his own cattle from those of other persons, and return the latter to the place from whence they were
driven. -
No person shall remove cattle beyond the
boundary of the Hundred other than those belonging
to him or for the removal of which he shall have due
authority. -
And whereas by a regulation duly passed by the
Wardens, under the provisions of Section one hundred
and three of the “Otago Waste Lands Act, 1866,” it is
provided that “no holder of a license to depasture
cattle upon the unfenced pasture lands within the
Mokoreta Hundred shall be entitled to depasture a
greater number than two head of great cattle, or ten
head of small cattle, for every acre of land which he
shall own or occupy, without the consent in writing of
the Wardens:” It is hereby provided that it shall be
lawful for the Wardens if they see fit to grant permission in writing to any such license holder so to depasture any number of cattle, upon payment to them
by way of assessment of the sum of five shillings for
every head of great cattle, and one shilling for every
head of small cattle so depastured during the current
year by such license holder in excess of the number
which he shall be entitled to depasture as above
provided. -
No person shall allow any swine belonging to
him or under his charge to wander at large upon the
Hundred without the consent in writing of the Wardens. -
All assessments for the current year on cattle
depastured within the Hundred shall be paid within
fourteen days after the publication of these Bye-laws
in the Government Gazette of the Province, or within
seven days after any such cattle shall have been placed
upon the Hundred, if so placed subsequent to such
publication. -
Any person offending against any of the foregoing
Bye-laws, shall forfeit any sum not exceeding five pounds for every such offence. -
All or any of the acts authorised by these Bye-
laws to be done by the Wardens or the majority of
them, may be done by any person duly authorised by
them in that behalf.
