In the Supreme Court of New Zealand,
Otago and Southland District.

In the matter of the Petition of Joseph Sykes Webb, of Dunedin aforesaid, Accountant, a Bankrupt,
and I do order that Joseph Sykes Webb, of Dunedin aforesaid, Accountant, be, and he is hereby appointed, sole trustee of the estate and effects of the said bankrupt, and I declare that this order shall be a vesting order: And I do further order, that all the real and personal estate and effects of the said bankrupt, which shall vest in the said Joseph Sykes Webb, by virtue of his said appointment, shall be held by him, his heirs, executors, and administrators respectively (except the wearing apparel of the bankrupt, his wife, and children, which shall be retained by them), upon and for the following trusts and purposes, that is to say:

  1. To sell, collect, and get in such real and personal estate, and receive the moneys arising therefrom, and execute all necessary conveyances and assurances therefor.

  2. To retain and pay all expenses, properly incurred, of and attendant upon such sale, collection, and getting in, as aforesaid.

  3. To pay the percentages and fees payable under the above-mentioned Acts.

  4. To pay the costs, properly incurred, of and incidental to the Petition in these matters, and subsequent thereto; and also all costs and expenses in these matters, which have been, or shall be, ordered by this honorable Court, or by any Judge thereof, to be paid out of the estate of the said bankrupt, all such costs as aforesaid, to be taxed by the Registrar of this honorable Court.

  5. To distribute the net residue of the said trust moneys between and amongst, and for the benefit of all the Creditors of the bankrupt, who were his Creditors at the time of the presentation of his said petition, and who shall duly prove their respective debts by affidavit, filed in the proper office of the Supreme Court, within three calendar months from the date of this order, by way of pro rata distribution, subject to existing legal priorities (if any such there be), but so that the said Creditors shall not receive more than twenty shillings in the pound upon the amount of their said respective debts.

  6. To pay the ultimate surplus, if any, of the said trust moneys to the said bankrupt.

NOTICE is hereby given that His Honor Mr. Justice Chapman has accepted the Petition of the above-named bankrupt, and has appointed Monday, the tenth day of September, 1866, at ten of the clock in the forenoon, at the Supreme Court House, Dunedin, for the hearing of the said Petition.

PRIVATE ADVERTISEMENTS will be charged at the rate of 6d. per line. Late Advertisements and table matter, 1s. per line first insertion.

The GAZETTE (with Supplement) is published every Wednesday morning, and Notices for Insertion must be received at the Publisher's Office not later than 2 o'clock p.m. on the Tuesday preceding. Advertisements received after that hour will be charged 1s. per line. Any irregularity in the receipt of those Gazettes which are given gratis by the Government should be reported at once to the Provincial Secretary.
