In the matter of the assignment by Donald M’Leod and James Gibson unto Robert Wilson, of Dunedin, Merchant, and Henry Miller, of Dunedin, Merchant, upon trust, for the collection and conversion into money of the said estate and effects, and the distribution of the net proceeds pro rata, and subject to existing legal priorities (if any), amongst such of the creditors of the said Petitioner as shall duly prove their respective debts by affidavit filed in the Office of the Registrar, at Dunedin, within the space of three calendar months after the date of the registration of the said Deed in this Court.

In the matter of SYDNEY THOMAS BULL, and FREDERICK DALE, both of Invercargill, in the Province of Southland, and Colony of New Zealand, Merchants, carrying on business in Invercargill aforesaid as Storekeepers and Merchants, under the style or firm of "Bull and Dale;" and in the matter of the Petition of John Macpherson, of Invercargill aforesaid, Merchant, sole partner of the firm of Macpherson and Company, creditor of the said Sydney Thomas Bull, and the said firm of "Bull and Dale" to the extent of not less than Fifty Pounds; and in the matter of the "Debtors and Creditors Act, 1862."

The third day of July, in the year of our Lord one thousand eight hundred and sixty-five.

Upon reading the above-mentioned Petition, and the minutes of meeting of creditors filed herein, and the two affidavits of the above-named John Macpherson, severally sworn and filed herein, and upon hearing Mr. Kenyon of Counsel for the said John Macpherson, it is ordered that Robert Chapman, Esquire, Registrar at Dunedin, in the Province of Otago, of this honourable Court, do in the name and on behalf of Sydney Thomas Bull and Frederick Dale above-named, cede and deliver, convey and assign, to the above-named John Macpherson and Robert Buchanan, of Invercargill aforesaid, merchants, their heirs, executors, administrators, and assigns respectively, according to the nature and quality thereof respectively, all the joint estate and effects of them, the said Sydney Thomas Bull and Frederick Dale, upon trust for the purpose of selling, disposing of, getting in and receiving, or otherwise realising the same, and in the first place of satisfying thereout all costs, charges, and expenses incurred by order of this Court, or incidental to the execution of the trust of such conveyance and assignment, and all fees of Court, and all payments to the insolvent estate fund, payable under section thirty-nine of the said Act, and such other sums (if any) as shall be ordered by this Court, and for the payment of all costs and expenses properly incurred up to this date by the above-named John Macpherson, as sequestrator of the estate and effects of the said insolvents, in and...
