LEASE OF ALBERT FERRY.
THIS DEED made the eighteenth day of February one thousand eight hundred and sixty-three Between HENRY NORMAN of Wanka in the Province of Otago New Zealand Ferry-keeper of the one part and his Honor JOHN LARKINS CHEESE RICHARDSON Esquire Superintendent of the said Province of the other part Witnesseth that the said John Larkins Cheese Richardson doth hereby demise unto the said Henry Norman all that the Albert Ferry situate and established at the junction of the Wanaka and Hawea Streams with the Clutha River in the said Province and the right to ply the same for the conveyance of passengers animals and goods across the Hawea and the Clutha Streams respectively with all the appurtenances thereunto belonging to hold the premises hereby demised unto the said Henry Norman his executors and administrators excluding assigns from the day of the date of these presents for the term of one year YIELDING AND PAYING therefor unto the said Superintendent and his successors in office one-tenth part of the gross Tolls or Ferryage levied and received by him during the said term without any deduction payable by equal quarterly payments on the eighteenth day of May the eighteenth day of August the eighteenth day of November and the eighteenth day of February all now next ensuing And the said Henry Norman doth hereby for himself his executors and administrators covenant with the said Superintendent and his said successors that he the said Henry Norman his executors and administrators during the said term shall at his and their own cost supply all boats punts chains oars ropes tackle and other gear necessary for conducting with safety to passengers and goods the business of the said Ferry and keep the same in good and safe condition and repair And also will not assign this lease or underlet or part with the possession of the said Ferry or any part thereof to any person or persons whomsoever And also will conduct the whole business of the said Ferry personally with such assistance as may be necessary for the safe and efficient working of the same And also will ply the said Ferry at all hours unless when from the state of the weather or other cause the passage would
be dangerous or impracticable And also will levy the following rates of Ferryage for the conveyance of persons carriages horses cattle sheep and goods and none other (except as hereinafter provided) that is to sayโFor each person one shilling; for each horse mule or ass not drawing any carriage two shillings; for each head of great cattle one shilling; for each sheep goat and hog when under twenty four pence; for each sheep goat and hog when twenty and upwards twopence; for each cart dray waggon and carriage of what kind soever exclusive of goods and passengers two shillings; for each horse mule ass and bullock drawing any cart dray waggon or other carriage one shilling; for each bale of wool one shilling; other goods at the rate of fourpence per one hundred pounds weight; and from one hour after sunset till sunrise the above fares and freight and one-half more shall be charged by the said Henry Norman his executors and administrators Provided always that the Mail and persons exhibiting a Certificate under the hand of the Superintendent for the time being that such persons are on duty under the employment of Government shall be exempted from the payment of rates of Ferryage And also shall and will keep a regular and daily account of all rates of Ferryage received by or due to him or them and transmit a copy thereof to the Superintendent for the time being at the end of every month certified by the said Henry Norman his executors or administrators to be a true account of the rates of Ferryage levied or that were leviable by him or them during each and every day of the month included in such account And also will observe any laws or rules already made or which shall be hereafter made by the Provincial Legislature or by the Superintendent of the Province for the time being relating to Ferries or for securing the orderly conduct of the business of the said Ferry to the satisfaction of the Government in all respects Provided always that if any laws or rules be passed altering the fares of the said Ferry or in the event of a Bridge being put across the said Ferry before the expiry of this demise it shall be at the option of the said Henry Norman his executors or administrators to relinquish the same at any time within one month from the passing of such laws or rules And also will at the expiration of the said term leave and deliver up the said Ferry And it is hereby declared and agreed that it shall not be necessary to that end that notice to quit be given or any legal proceedings whatsoever be had or taken Provided always that if the Rent or Sums hereinbefore reserved or any part thereof shall be in arrear for twenty-one days after any of the said days
