state of the weather from prosecuting her
voyage or approaching any of the said
ports and places on the coast, being other-
wise in readiness for the work, the time so
lost shall be counted as occupied in the
business of the contract: and lastly, the
said parties hereto do hereby bind and
oblige themselves the one to the other of
them for the due performance of the cove-
nants and agreements hereinbefore ex-
pressed and contained, in the penalty of
three hundred pounds sterling, to be paid
by the party failing to perform to the party
performing and willing to perform the
same.—In witness whereof the said parties
hereto have hereunto set their hands and
seal the day and year first above written.

THIS INDENTURE, made the first
day of May, one thousand eight hun-
dred and sixty, between FREDERIC GREER,
of Dunedin, in the Province of Otago, New
Zealand, merchant, of the one part, and
his Honor JAMES MACANDREW, Esquire,
Superintendent of the said Province, of the
other part: Whereas the Provincial Go-
vernment of Otago has resolved upon
granting a subsidy for the coasting steam
service of the said Province, and whereas
the said Frederic Greer, sole owner of the
sea-going steam vessel "Oberon," of one
hundred and one tons burthen, and twenty-
five horse-power engines, or thereabouts,
hath proposed and agreed to and with the
said James Macandrew, Superintendent as
aforesaid, to ply the said vessel continuous-
ly, and under the regulations hereinafter
mentioned, between the Port of Otago and
the several rivers, harbours, bays, and
landing-places hereinafter mentioned, and
to carry passengers as well as goods, for
the period of two years, for the annual
subsidy hereinafter expressed: Now this
Indenture witnesseth, that in pursuance of
the said agreement, and in consideration of
the annual sum of Fifteen hundred pounds
sterling, to be paid as hereinafter mentioned,
he, the said Frederic Greer, for himself,
his heirs, executors, and administrators,
doth hereby covenant, promise, and agree
to and with the said James Macandrew,
Superintendent as aforesaid, and his suc-
cessors in office, that he, the said Frederic
Greer, his executors and administrators,
shall and will cause the said sea-going
steam vessel "Oberon," or some other sea-
going steam vessel of equal tonnage and
horse-power engines, to be approved of by
the said James Macandrew, or his successors
in office, to run and ply continuously and
successively without intermission, between
the Port of Dunedin; the Taieri River, as
far as navigable by the said vessel with
safety; the Clutha River, as far as navig-
able by the said vessel with safety; the
Bluff, Invercargill, and Jacob's River twice
in every calendar month; and the Waikawa
and Mataura once in every calendar month,
for the period of two years, commencing
from the first day of April, one thousand
eight hundred and sixty, and shall and
will, during all that time, uphold and
maintain the vessel, so to be employed, in
good and substantial repair and condition
in all respects; provided, nevertheless, that
