THIS DEED, made the twenty-eighth day of March, eighteen hundred and fifty-nine, between his Honor William Cargill, Esquire, Superintendent of the Province of Otago, of the one part; and William Hunter Reynolds, of Dunedin, in the said Province, Merchant, of the other part:

WHEREAS, in pursuance of the "Leases of Jetty Reserves Ordinance 1858," passed by the Superintendent and Provincial Council of the said Province, there was exposed to sale by auction to the highest bidder, a lease, for the period and for the purpose and upon the conditions aforementioned, of all that piece of ground hereinafter described; and the said William Hunter Reynolds having offered for the same the upset yearly rent being the yearly rent hereinafter mentioned, and being the only bidder, was declared to be lessee, and thereupon signed the conditions of sale: And whereas it is thereby conditioned that the lessee shall enter into a regular lease containing the said conditions and all usual and necessary clauses;β€”Now this Deed, made or intended to be made in pursuance of an Ordinance passed in the fifth year of the reign of Her Majesty Queen Victoria, Session II., No. 10, entitled "An Ordinance to facilitate the transfer of Real Property, and to simplify the law relating thereto:" WITNESSETH, that in consideration of the yearly rent and of the other obligations by the lessee hereinafter stipulated and undertaken, the Superintendent of the said Province of Otago hath demised and let, and doth hereby demise and let to the said William Hunter Reynolds, his heirs and assigns (except as after-mentioned), that piece of ground situated near to the Public Jetty in the Town of Dunedin, measuring and bounded as follows, conform to a plan signed by the parties as relative hereto, viz.:

  • On the north by section marked number seven, and measuring one hundred and ten links;
  • On the east by a reserved road along the sea beach, and measuring one hundred and five links;
  • On the south by the ground in the possession or occupation of John Jones, and another part of the Jetty Reserve, measuring one hundred and ten links;
  • And on the west by section marked number seven, and measuring seventy-eight links;

For the period and for the purpose and upon the conditions and yielding, and the said William Hunter Reynolds, his heirs,
