In pursuance of the powers of the Dunedin Roads and Streets Ordinance, 1855, passed by the Provincial Legislature of Otago, Session II. No. 15, the Town Board of Dunedin certify that the sum of __, being the amount (or a proportion) of the expense incurred by the said Board for (here specify the nature of the work done) became payable upon (specify the date) and is still owing, with __ of costs of proceedings instituted for recovery of the same, including the fee for recording this minute: And therefore the said Board declare the said two sums, amounting to __, with interest thereon at the rate of ten per centum per annum till paid, to be a real burden upon (here specify the subjects) now or lately the property of E. F.

FORM OF DISCHARGE TO BE WRITTEN ON THE REGISTERED MINUTE.

In respect of the within mentioned sum of __ with __ of interest thereon having been paid to me, I, Treasurer to the Town Board of Dunedin, do hereby discharge the within mentioned property of said debts.

NOTICE.

As the provisions of the Constabulary Force Ordinance, Sess. I, No. 9, New Munster, may not be generally known, the said Ordinance is now published for general information.

The powers thereby vested in the Governor and Lieutenant-Governor are by the Empowering Ordinance, Sess. I. No. 6, vested in the Superintendent; and the clauses within [ ], applicable to the Resident Magistrate, are abrogated by the Town Board being constituted Commissioners.—See section 2 of the Dunedin Roads and Streets Ordinance.


CONSTABULARY FORCE ORDINANCE.

1849.

ANALYSIS.

Preamble.

  1. Power to any in the Constabulary Force above the rank of a Private Constable to board ships, boats, or other vessels.
  2. Provision for punishing disorderly conduct in the houses of Licensed Victuallers, extended to other houses.
  3. Fine for Drunkenness.
  4. Power to any two Justices of the Peace to imprison persons having certain implements with felonious intent.
  5. Power to Constables to arrest persons with stolen property upon them.
  6. Penalty for damaging public buildings.
  7. Penalty on persons committing certain acts in the nature of nuisances specified in Schedule A.
  8. Power to Constables to seize certain articles enumerated in Schedule A.
  9. Penalty for discharging Fire Arms and Fireworks.
  10. Penalty for leaving Shavings or other things in the street, and setting fire to the Bush.
  11. Penalty for Bathing in public.
  12. Penalty for exposing the person.
  13. Penalty for Nuisances.
  14. Penalty for injuring the Streets by hauling Timber, &c., thereon.
  15. Penalty for uncovering openings in the Foot-ways.
  16. Penalty for making any opening in the Foot-way.

  32. Commencement of Ordinance.

AN ORDINANCE to Increase the Efficiency of the Constabulary Force.

WHEREAS an Ordinance No. 2, Session 7, to provide for the establishment of a Constabulary Force, was passed on the 9th October 1846; and whereas it is expedient to increase the efficiency of the said Force:

  1. Be it enacted, by His Excellency the Lieutenant-Governor of New Munster, with the advice and consent of the Legislative Council thereof, as follows:

    That any Inspector, Sub-Inspector, or any Officer of the Constabulary Force above the rank of a private Constable, may with such Constables as he may think proper, enter into any ship, boat, or other vessel, (not being then actually employed in Her Majesty’s Service,) for the purpose of inspecting and directing the conduct of any Constable who may be stationed on board of any such vessel, and the conduct of all other parties who shall be employed on board.
