  1. So much of the several sums appropriated for the public services of the half-year preceding the said 1st day of April, one thousand eight hundred and fifty-five, by the Appropriation Ordinance, passed in the present Session of the Provincial Council, No. 3, as shall not have been applied during said half-year, for the purposes for which they were appropriated, or as shall remain over after defraying the charges for the services of said half-year, shall be available, and are hereby authorised to be appropriated, if needful, for the said purposes and services of and during the half-year commencing upon the first day of April, one thousand eight hundred and fifty-five; and in like manner, any part of the foregoing sums may be applied, if necessary, in payment of expense incurred for services under the corresponding head during the half-year preceding said first day of April.

  2. The Provincial Treasurer shall issue and pay from time to time any sum or sums of money for the purposes hereinbefore mentioned, not exceeding in whole the sums respectively stated in this and said other Appropriation Ordinance, to such persons, and in such portions as the Superintendent shall, by Warrant or Warrants signed by him, from time to time direct, and such Treasurer shall in his account be allowed credit for all sums paid by him in pursuance of such warrant or warrants, and the receipts of the persons to whom such sums shall have been so paid shall be to him a full discharge for the sum or sums for which such receipt shall have been given, and the amount thereof shall be passed to his credit in account accordingly.

  3. This Ordinance shall come into operation upon the first day of April, one thousand eight hundred and fifty-five.

Resolution of Council, 26th April, 1855.

"Having duly considered the Message of his Honor the Superintendent, together with the accompanying Correspondence, by which it appears that Mr. George Shand claims to be entitled to select a section of Rural Land, in virtue of a Land-Order, subsequent to said section having been withdrawn from sale by the Commissioner of Crown Lands, as instructed by his Honor the Superintendent, in virtue of the authority conveyed to his Honor by his Excellency the Officer administering the Government, under date 25th May last, and in accordance with the temporary Regulations for the immediate occupation of land; now in force—Regulations which have been adopted for the purpose of promoting the public interest, and of meeting a great and pressing emergency.

"Resolved—That it is essential to the interests of the Province that the authority conveyed to his Honor the Superintendent under the Governor’s Instructions of 25th May last, should be maintained; otherwise the Regulations now in force for the immediate occupation of the Waste Lands of the Crown cannot be carried out. It would be impossible to reserve any land that may have been surveyed, however necessary such reserves may be to the interests of the Settlers; and no stop can be put to the mischievous effects to the public of the wholesale selection of Bush Land by individuals. It is therefore desirable that the validity of the power of his Honor the Superintendent, with reference to the subject under consideration, should be maintained; in the event of the same being infringed; and the Council resolves that a respectful address be transmitted to his Honor the Superintendent, requesting that he may be pleased to take all necessary steps to vindicate the powers conferred upon him respecting its farther declaration, to bear out and exonerate his Honor, as well as the Crown Commissioner, in any responsibility which they may incur, in carrying out the regulations in question; and assuring his Honor of its readiness, on his recommendation, to appropriate whatever sum may be necessary, in order to defend his authority and assert his right to fulfil the Regulations to which the Council is pledged."
