NEW ZEALAND GAZETTE, No. 90 — 7 SEPTEMBER 2017

In accordance with section 34(1)(a) of the Civil Aviation Act 1990, the Minister of Transport hereby gives notice of his intention to make the following ordinary Civil Aviation Rules.

Part 91 – General Operating and Flight Rules

Part 121 – Air Operations – Large Aeroplanes

Part 129 – Foreign Air Transport Operator – Certification

The purpose of this proposal is to amend Part 91 to establish a performance-based regulatory framework for aircraft emergency location equipment for installation in New Zealand registered aircraft operating within the New Zealand Flight Information Region. It proposes the removal of the prescriptive requirement for one type of ELT technology and gives the Director of Civil Aviation the discretion to approve equipment that meets specified performance criteria.

In addition, this proposal also adopts part of ICAO Amendment 40 to Annex 6 Part 1 – Operation of Aircraft relating to carriage of ELTs. Part 121 and Part 129 are proposed to be amended to reflect this.

New Zealand Transport Agency (Auckland Electric Vehicles – Phase 2 Trial) Bylaw 2017

Pursuant to section 61(3) of the Government Roading Powers Act 1989, the NZ Transport Agency makes the following bylaw.

Bylaw

  1. Title—This bylaw is the New Zealand Transport Agency (Auckland Electric Vehicles – Phase 2 Trial) Bylaw 2017.

  2. Commencement—Clause 5 comes into force on the day after the notification of this bylaw in the New Zealand Gazette.

  3. Revocation—This bylaw will be revoked on 8 September 2018.

  4. Interpretation—(1) In this bylaw:

    electric vehicle means a motor vehicle with motive power wholly or partially derived from an external source of electricity.

    (2) A term that is used in this bylaw and defined in the Land Transport Act 1998 but not defined in this bylaw has the meaning given in that Act.

  5. Electric vehicle may use specified special vehicle lanes—A driver of an electric vehicle may drive in a special vehicle lane specified in the Schedule.

  6. Authority to make bylaw—This bylaw was made by the Chief Advisor Operational Policy, Planning and Performance, under the delegated authority of the NZ Transport Agency.
