Notification of Making Marine Protection Rules
Pursuant to section 448(2) of the Maritime Transport Act 1994, Maritime New Zealand gives notice of the making of the following marine protection rules:
Marine Protection Rules Part 102 Amendment 2017.
These rules were signed on 3 September 2017 and will come into force as follows:
- Entry into force is suspended until it is applied by the Minister by notice in the New Zealand Gazette, under section 451(3) of the Maritime Transport Act 1994.
These rules are available for inspection free of charge, or for purchase, from Maritime New Zealand, Level 11, 1 Grey Street, Wellington, or on the Maritime New Zealand website at: www.maritimenz.govt.nz/rules.

Electricity Industry (Exemption No. 262 (Nova Energy Limited)) Exemption Notice 2017
Under section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.
Notice
- Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 262 (Nova Energy Limited)) Exemption Notice 2017.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
- Exemption—(1) Nova Energy Limited (“Nova”) is exempted from complying with the obligation in clause 10.24(c) of the Electricity Industry Participation Code 2010 (“Code”) not to use subtraction to determine submission information.
(2) This exemption applies only to ICP 0008201110WM5F5.
- Term—This exemption expires on the earlier of:
a. the close of 28 February 2018; and
b. the completion date of a new supply point to Taharoa Village upstream of New Zealand Steel Limited’s Taharoa ironsands mine.
- Reasons for granting the exemption—The reasons for granting this exemption are:
a. the exemption from clause 10.24(c) of the Code will allow Nova to use subtraction to determine submission information, even though ICP 0008201110WM5F5 is not also a network supply point (NSP);
b. deriving the submission information from the metering installations by subtraction is as accurate as it would be if it was derived using directly metered data;
c. the exemption will have no impact on any other participant or service provider, and will not affect any other Code provision; and
d. the exemption meets the requirements in section 11(2) of the Act.
