Notice of Approval Given Pursuant to Section 160(3) of the Crown Entities Act 2004

Pursuant to section 160(3) of the Crown Entities Act 2004, I, Gina Tiare Butson, Senior Solicitor, give notice that on or about 8 December 2016 the Honourable Simon William English, Minister responsible for Housing New Zealand Corporation, and the Honourable Paula Bennett, acting as Minister of Finance, gave approval under section 160(1)(b) of the Crown Entities Act 2004, in relation to section 163 of that Act, for Housing New Zealand Limited to provide indemnities to reimburse AP Properties Tauranga 2016 LP in relation to specified risks, costs and expenses under an agreement for sale and purchase between Housing New Zealand Limited and AP Properties Tauranga 2016 LP.

Amendment of Notice of Direction to Appoint a Limited Statutory Manager for the Piopio College (162) Board of Trustees

Under section 78M(6) of the Education Act 1989, and acting under delegated authority, the notice (as published in the New Zealand Gazette, 17 December 2015, Issue No. 141, Notice No. 2015-go7452) directing the Secretary for Education to appoint a limited statutory manager for the Piopio College (162) Board of Trustees is amended by replacing:

“The following functions, powers and duties of the board are to be vested in a limited statutory manager:

  • All functions, powers and duties of the board as an employer (whether statutory or otherwise);
  • all functions, powers and duties of the board to manage all communications (whether statutory or otherwise) including communications with the media, communications within the school, and communications between the school and its community; and
  • all functions, powers and duties of the board in relation to property management (whether statutory or otherwise).

A limited statutory manager must also advise the board on:

  • financial matters; and
  • consolidating all new and improved systems into board management practice.”

with:

“The following functions, powers and duties are vested in the limited statutory manager:

  • All functions, powers and duties of the board as an employer whether statutory or otherwise).

A limited statutory manager must also advise the board on finance.”

The board will retain its primary duty of care as a person conducting a business or undertaking, under the Health and Safety at Work Act 2015, above and beyond all functions, powers and duties of this limited statutory manager.

This notice takes effect on the date of publication.
