C. The conditions setting limits on fees subsequently specified by the Minister in accordance with section 159L(3)(d) of the Act must be imposed as conditions on funding payable by the TEC to an organisation under section 159YA and 159ZC of the Act.

D. Under sections 227(1A) and 234A of the Act, TEIs and PTEs respectively must not charge domestic students a fee that exceeds the maximum specified as a condition on funding approved by the TEC under section 159YA and section 159ZC of the Act.

Revocation of Notice of Direction to Appoint a Limited Statutory Manager for the Ngapuke School (1847) Board of Trustees

Under section 78M(7) of the Education Act 1989, (acting under delegated authority) I hereby revoke the notice of direction to appoint a limited statutory manager for the Ngapuke School (1847) Board of Trustees (as published in the New Zealand Gazette, 31 January 2013, No. 11, page 383).

This notice takes effect on the day of publication.

Revocation of Notice of Direction to Appoint a Limited Statutory Manager for the Mana College (254) Board of Trustees

Under section 78M(7) of the Education Act 1989, (acting under delegated authority) I hereby revoke the notice of direction to appoint a limited statutory manager for the Mana College (254) Board of Trustees (as published in the New Zealand Gazette, 12 March 2015, Issue No. 24, Notice No. 2015-go1440).

This notice takes effect on the day of publication.

Notice of Direction to Appoint a Limited Statutory Manager for the Wilford School (3072) Board of Trustees

Under section 78M of the Education Act 1989, with delegated authority from the Minister of Education, I hereby direct the appointment of a limited statutory manager for the Wilford School (3072) Board of Trustees.

The following functions, powers and duties of the board are to be vested in a limited statutory manager:

All functions, powers and duties of the board as an employer (whether statutory or otherwise);
all functions, powers and duties of the board in curriculum management including teaching and assessment practice (whether statutory or otherwise); and
all functions, powers and duties of the board to establish board policies and procedures.

A limited statutory manager must also advise the board on the following matters:

Board communications (whether statutory or otherwise).

The board will retain its primary duty of care as a person conducting a business or undertaking, under the Health and Safety at Work Act 2015, above and beyond all functions, powers and duties of this limited statutory manager.
