Notification of Commencement of Section 30R Reviews of the Schedule 2 Price Lists of Standard Terms Determinations of Seven Regulated Telecommunications Services

In accordance with section 30R(5)(b) of the Telecommunications Act 2001 ("Act"), the Commerce Commission ("Commission") gives public notice of its decision to commence reviews of the Schedule 2 (Price Lists) of the following standard terms determinations ("STDs"):

  • Chorus’ Unbundled Bitstream Access Service (UBA);
  • Chorus’ Unbundled Copper Local Loop Service (UCLL);
  • Chorus’ Unbundled Cooper Low Frequency Service (UCLF);
  • Chorus’ Unbundled Bitstream Access Backhaul Service (UBA Backhaul);
  • Chorus’ Unbundled Copper Local Loop and Unbundled Copper Low Frequency Network Backhaul (Telephone exchange to interconnect point) Service (UCLL and UCLF Backhaul);
  • Chorus’ Unbundled Copper Local Loop and Unbundled Copper Low Frequency Network Co-location Service (UCLL and UCLF Co-location); and
  • Chorus’ Sub-loop Unbundled Copper Local Loop Services (SLU).

Under section 30R(1) of the Act, the Commission may, on its own initiative, commence a review, at any time, of all or any of the terms specified in a STD.

The Commission has prepared and published drafts of the proposed amendments to the Schedule 2 Price Lists of each STD.

The Commission invites submissions on these drafts under section 30R(5)(c) of the Act by 28 April 2017 at 5.00pm.

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting, during the period from 3 March 2017 to 6 April 2017 inclusive, of the following exemptions:

  • 1 from Maritime Rule 19.62(1) – Maritime Transport Operator – Certification and Responsibilities – Operating Requirements – Maritime transport operator responsible for safe ships – Valid Certificate of Survey issued under Rule 44.41.

  • 1 from Maritime Rule 22.20(5), Appendix 1, 3(4) – Collision Prevention – Lights and shapes – Horizontal positioning and spacing of masthead light for power-driven vessel.

  • 1 from Maritime Rule 31.34(1)(a)–(b) – Crewing and Watchkeeping – SOLAS and STCW ships – Unlimited area – Requirements for ships operating in unlimited areas to carry at least navigational and engine room watchkeepers as specified.

  • 2 from Maritime Rule 31.84(2)(b) – Crewing and Watchkeeping – Minimum crewing requirements for other ships – Seafarers holding minimum required certificates and minimum number of crew specified applicable table and flow-chart.

  • 2 from Maritime Rule 31.84(4)(b), Table 11 – Crewing and Watchkeeping – Minimum crewing requirements for
