Notice of Direction to Appoint a Limited Statutory Manager for Golden Bay High School (292) Board of Trustees

Under section 78M of the Education Act 1989, I hereby direct the appointment of a limited statutory manager for the Golden Bay High School (292) Board of Trustees.

The following functions, powers and duties of the board are to be vested in a limited statutory manager:

  • All functions, powers and duties of the board as an employer (whether statutory or otherwise);
  • all functions, powers and duties of the board in relation to property management (whether statutory or otherwise); and
  • all functions, powers and duties of board to manage financial operations (whether statutory or otherwise).

The board will retain its primary duty of care as a person conducting a business or undertaking, under the Health and Safety at Work Act 2015, above and beyond all functions, powers and duties of this limited statutory manager.

This notice takes effect on the day of publication.

Notice That Anti-dumping Duties on Peaches in Preserving Liquid From China and Standard Plasterboard From Thailand May Cease to Apply

Pursuant to section 14(9) of the Dumping and Countervailing Duties Act 1988 (“Act”), anti-dumping duties imposed on peaches in preserving liquid from China, and standard plasterboard from Thailand will cease to apply to those goods on 17 July 2017 (“cessation date”), unless at that date the goods are subject to review under section 14(8) of the Act.

Any interested party that might request that the Chief Executive of the Ministry of Business, Innovation and Employment initiate a review of either of these duties before the cessation date should be aware that positive evidence justifying the need for a review must be provided to the chief executive.

Positive evidence justifying the need for a review would need to include reasons and evidence for believing that:

  • the expiry of the anti-dumping duties would see the continuation or recurrence of dumping of the goods subject to the duties; and
  • such dumping would likely cause the continuation or recurrence of material injury to the New Zealand industry producing goods like those subject to the duties.
