Declaration by Electoral Commission That Raymond Huo is Elected a Member of Parliament

WHEREASβ€”

A. The Electoral Commission has received a warrant from Her Excellency the Governor-General to supply a member of Parliament to fill a vacancy created by the resignation of Jacinda Ardern pursuant to section 55(1)(f) of the Electoral Act 1993;

B. Under section 137(2) of the Electoral Act 1993, the Electoral Commission has determined that, of the unelected candidates on the party list of the New Zealand Labour Party, Maryan Street stood highest in the order of preference on that list;

C. Under section 137(3) of that Act, the Electoral Commission has asked the Secretary of the New Zealand Labour Party whether Maryan Street remains a member of that party and the Commission has been informed that she remains a member of that party;

D. Under section 137(4) of that Act, the Electoral Commission has asked Maryan Street whether she is willing to be a member of Parliament and she has indicated that she is not willing to be a member of Parliament.

E. Under section 137(5) of the Electoral Act 1993, the Electoral Commission has determined that, of the unelected candidates on the party list of the New Zealand Labour Party, Moana Lynore Mackey stood next highest in the order of preference on that list;

F. Under section 137(3) of that Act, the Electoral Commission has asked the Secretary of the New Zealand Labour Party whether Moana Lynore Mackey remains a member of that party and the Commission has been informed that she remains a member of that party;

G. Under section 137(4) of that Act, the Electoral Commission has asked Moana Lynore Mackey whether she is willing to be a member of Parliament and she has indicated that she is not willing to be a member of Parliament;

H. Under section 137(5) of the Electoral Act 1993, the Electoral Commission has determined that, of the unelected candidates on the party list of the New Zealand Labour Party, Raymond Huo stood next highest in the order of preference on that list;

I. Under section 137(3) of that Act, the Electoral Commission has asked the Secretary of the New Zealand Labour Party whether Raymond Huo remains a member of that party and the Commission has been informed that he remains a member of that party;

J. Under section 137(4) of that Act, the Electoral Commission has asked Raymond Huo whether he is willing to be a member of Parliament and he has indicated that he is willing to be a member of Parliament.

THEREFORE, pursuant to section 137(5) of that Act, the Electoral Commission declares that

Raymond Huo

is elected as a member of Parliament by publication of this declaration in the New Zealand Gazette.
