  1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 254 (Pioneer Energy Limited)) Exemption Notice 2017.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

  1. Exemption—Pioneer Energy Limited ("Pioneer") is exempted from complying with the obligation in clause 15.38 of the Electricity Industry Participation Code 2010 ("Code") to obtain and maintain certification as a reconciliation participant.

  2. Term—This exemption expires on the close of 31 August 2017.

  3. Reasons for granting the exemption—The reasons for granting this exemption are:

a. Pioneer has completed an audit demonstrating its ability to comply with the relevant obligations in the Code;

b. a new auditing regime, which comes into force on 1 June 2017, removes the requirement for Pioneer as a reconciliation participant to obtain ISO quality certification;

c. the exemption will have little or no impact on other participants or service providers, and will not affect any other Code provisions; and

d. granting the requested exemption meets the requirements in section 11(2) of the Act.

Electricity Industry (Exemption No. 256 (Genesis Energy Limited)) Exemption Notice 2017

In accordance with section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority ("Authority") gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 256 (Genesis Energy Limited)) Exemption Notice 2017.

(2) This notice comes into force on 1 March 2017.

  1. Exemption—Genesis Energy Limited ("Genesis") is exempted from complying with the obligation in clause 15.8 of the Electricity Industry Participation Code 2010 ("Code") to provide the reconciliation manager with Genesis’ total monthly quantity of electricity supplied for each half-hourly ("HHR") metered installation control point (ICP) that has a category 1 or 2 advanced metering infrastructure (AMI) meter and is reconciled as HHR.

  2. Term—This exemption expires at the close of 1 October 2017.

  3. Reasons for granting the exemption—The reasons for granting this exemption are:

a. the exemption will prevent inefficient investment in manual systems by Genesis while a Code amendment is being considered;

b. Authority staff are considering whether to recommend that a Code amendment is necessary and, if one is necessary, what form it will take. This is because monthly HHR aggregated information was originally intended to be used to ensure that all HHR data was submitted by traders for legacy (commercial and industrial) HHR metering installations at the time that an ICP was switched and not for AMI HHR metering installations; and

c. granting the requested exemption meets the requirements in section 11(2) of the Act.
