Frequency use is on a shared basis and the chief executive does not accept liability under any circumstances for any loss or damage of any kind occasioned by the unavailability of frequencies or interference to reception.

These frequencies are also used by land mobile services. On-board maritime communications should be avoided when vessels are within the pilotage areas defined in the Schedule to Part 90 of the Maritime Rules published by Maritime New Zealand, or within a radius of WGS84 co-ordinates:
a. 70 nautical miles from 174°46′E 36°50′S (Auckland).
b. 76 nautical miles from 172°49′E 43°33′S (Christchurch).

Should interference occur to services licensed pursuant to a radio licence or a spectrum licence, the chief executive reserves the right to require and ensure that any transmission or any emission pursuant to this General User Radio Licence change frequency, reduce power, or cease operation.

Consequential revocation of licence—(1) The Radiocommunications Regulations (General User Radio Licence for Maritime UHF On-Board Communications) Notice 2011, dated 2 May 2011 and published in the New Zealand Gazette, 5 May 2011, No. 59, page 1372, is revoked.
(2) Notwithstanding the revocation of the notice under subsection (1), every transmitter capable of making transmissions compliant with the requirements of that notice on the commencement date of this notice is deemed to be compliant with the requirements of this notice.

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice provides additional channels for on-board maritime UHF communications as reflected in the changes to the International Radio Regulations, as a result of decisions made at the 2015 World Radio Conference. This enables 6.25 kHz and 12.5 kHz channels for use on-board vessels.
