WHEREAS:

John Baptiste ("owner") is the registered owner of the property mentioned in the Schedule hereto.

Public Trust has been informed and believes after due enquiry that the owner is no longer resident in New Zealand and it is not known where the owner of the property is or whether or not the owner of the property is alive or dead.

After due enquiry Public Trust does not know whether the owner of the property has any agent or administrator in New Zealand with authority to take possession of and administer the property; or where the agent or administrator is; or whether the agent or administrator is alive or dead.

The gross value of the property (as estimated by Public Trust) does not exceed $40,000.00.

Public Trust is satisfied that it is advisable in the interests of another person that Public Trust elects to be the manager of the property under Part VII of the Public Trust Act 2001.

Public Trust has advertised its intention to elect to be the manager of the Property in the 6 July 2016 edition of the Otago Daily Times, which is a newspaper circulating in the locality where the property is situated and believed by Public Trust to be an appropriate advertising medium.
Now, therefore, Public Trust, in exercise of the authority conferred on it by section 101(1) of the Public Trust Act 2001, hereby elects to be Manager of the Property under Part VII of the Act.
Schedule
Section 9 Block IX Town of Moeraki (being the land contained in certificate of title OT8B/67 (Otago Land Registry)).
This piece of land is located at Haven Street, Moeraki.

The owners of land adjoining the bank of Awanui Stream in Hastings District have applied to me to bring parts of the dry bed of the Awanui Stream under the provisions of the Land Transfer Act 1952 and issue Computer Registers for it in their names.
Land Registration District: Hawke’s Bay.
Application: 10447629.1.
Applicants: Alec Howard Milligan, Carol Tracey Milligan and WTR Trustee (2013) Limited, c/o Willis Toomey Robinson Scannell Hardy, Private Bag 6018, Hawke’s Bay Mail Centre, Napier 4142.
Land Applied for: 1247 square metres, more or less, shown on LT 486331, being parts of the former bed of Awanui Stream adjoining Kahumoko D5A1 Block, Kahumoko D5A2 Block and Lot 1 DP 27894 comprised in Computer Registers HB123/293, HB33/229 and HBW4/1069 respectively in the Hastings District.
I hereby give notice of my intention to bring the land applied for under the provisions of the Land Transfer Act 1952 and issue titles for it in the names of the applicants unless a caveat forbidding the same is lodged on or before 28 September 2016.
