Minister for Primary Industries’ Response to the Commerce Commission’s Report on the State of Competition in the New Zealand Dairy Industry (Notice No. MPI 627)

I, the Hounourable Nathan Guy, Minister for Primary Industries, received the Commerce Commission’s report on the state of competition in the New Zealand dairy industry on 1 March 2016.

Pursuant to section 148(3) of the Dairy Industry Restructuring Act 2001 (“Act”), I hereby give notice that I intend to promote the enactment of legislation that will both:

  • reset the market share thresholds in section 147 of the Act; and
  • promote the adoption of measures that provide a transition pathway to deregulation of the New Zealand dairy industry.

The Ministry for Primary Industries has released a document discussing options for achieving these aims. I intend to consider feedback from industry and the wider public before making any policy decisions or introducing legislation. A link to the discussion document can be found at
