NEW ZEALAND GAZETTE, No. 46 — 26 MAY 2016
a. Pursuant to section 55, revokes the notice dated 15 February 2016 acquiring land for reserve, published in the New Zealand Gazette, 18 February 2016, Issue No. 14, Notice No. 2016-ln859.
b. Pursuant to section 20, declares that, an agreement to that effect having been entered into, the land described in the Schedule to this notice is hereby acquired for recreation reserve purposes, subject to the Reserves Act 1977, and shall vest in the Waimate District Council on 18 February 2016, being the date the revoked notice, in (a) above, was published in the New Zealand Gazette and took effect.
c. Pursuant to section 48, declares that an easement is granted over the land described in the Schedule to this notice, subject to the rights and powers implied and attaching to a right of way easement as set out in Schedule 4 of the Land Transfer Regulations 2002, for access on foot or with machinery, for the purposes of drain and stop bank maintenance, and shall be appurtenant to the balance land in Computer Freehold Register CB22K/675.

Pursuant to sections 20(1) and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Zak Sun, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the easement in gross described in the First Schedule to this notice is acquired over the land of The Tasman Fruitpackers Limited ("Grantor"), on the terms and conditions set out in the Second Schedule.
