d. when embedded generation is injected through any one of the four meters currently used in the calculation of submission information by subtraction.
4. Reasons for granting the exemption
The reasons for granting this exemption are:
a. AccuCal will otherwise incur significant metering installation expenditure that would outweigh any benefit resulting from compliance;
b. AccuCal cannot comply with the obligation in clause 4(2)(a) of Schedule 10.7 of the Code until Meridian authorises AccuCal to install new metering installations at the Clandeboye dairy factory;
c. deriving the submission information from the metering installations by subtraction is as accurate as it would be if it was derived using directly metered data;
d. the exemption will have no impact on any other participant or service provider, and will not affect any other Code provision; and
e. granting the requested exemption meets the requirements in section 11(2) of the Act.

Notice of Requirements for Granting of Certificates of Competence Under the Health and Safety in Employment (Mining Operations and Quarrying Operations) Regulations 2013 Amendment No. 3
Under Regulation 34(a) of the Health and Safety at Work (Mining Operations and Quarrying Operations) Regulations 2016, WorkSafe New Zealand gives notice of the qualifications and experience required for the granting of certificates of competence under Regulation 41.
1. Commencement
This notice comes into force on 22 December 2016.
2. Principal notice
This notice amends the Notice of Requirements for Granting of Certificates of Competence Under the Health and Safety in Employment (Mining Operations and Quarrying Operations) Regulations 2013 (published in the New Zealand Gazette, 18 December 2014, Issue No. 153, Notice No. 2014-au7793) ("principal notice").
3. Interpretation
The clause entitled "Interpretation" of the principal notice is amended by inserting, after the definition of "regulations", the following definition:
savings provision means clause 7(5) of Schedule 1 of the Health and Safety at Work (Mining Operations and Quarrying Operations) Regulations 2016.
4. Clause entitled "Certificate of competence as a B-grade quarry manager" amended
Paragraph (3)(a) of the clause entitled "Certificate of competence as a B-grade quarry manager" is amended by deleting
"as a B-grade quarry manager under the former regulations"
and substituting
"as an A-grade quarry manager or a B-grade quarry manager under the former regulations, or a certificate of competence as an A-grade quarry manager to which the savings provision applies".
5. Clause entitled "Examination by panel of examiners" amended
Paragraph (5) of the clause entitled "Examination by panel of examiners" is amended by inserting, after paragraph (5):
"(5A) Nothing in paragraph (2) applies to an applicant for a certificate of competence as a B-grade quarry manager who holds a certificate of competence as an A-grade quarry manager under the former regulations, or a certificate of competence as an A-grade quarry manager to which the savings provision applies."
