"4A. Notification of storage of polychlorinated biphenyls
Any collector who stores polychlorinated biphenyls to which this notice applies must notify the Authority in writing of the following matters:
(a) the name and address of the collector;
(b) the location at which the polychlorinated biphenyls are being stored; and
(c) the amount of polychlorinated biphenyls being stored at that location."
- Clause 5 amended (Disposal of persistent organic pollutants)—(1) After clause 5(1)(b), replace "." with "; or".
(2) After clause 5(1)(b), insert:
"(c) by importing the substance into New Zealand for subsequent export from New Zealand as waste for environmentally sound disposal provided that such export complies with the relevant requirements of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal, the Stockholm Convention on Persistent Organic Pollutants and the OECD Decision C (2001)107 on the Control of Transboundary Movement of Wastes Destined for Recovery Operations."
(3) Delete clause 5(2).
- Schedule amended (Controls on collectors of persistent organic pollutants)—(1) Under the heading "Packaging for persistent organic pollutants", insert:
"In the case of polychlorinated biphenyls, if the quantity is less than 1 litre for liquids or 1kg for solids, Schedule 4 of the Hazardous Substances (Packaging) Regulations 2001 apply."
(2) Under the heading "Transport of persistent organic pollutants" replace "1999" with "2005".
(3) Under the heading "Emergency Management", delete the paragraph and replace with:
"The Hazardous Substances (Emergency Management) Regulations 2001 apply to persistent organic pollutants as if they are deemed to have hazard classifications that are class 6.1B and 9.1A, except in the case of polychlorinated biphenyls, which will be deemed to have hazard classifications of 6.8A, 6.9A and 9.1A."
(4) Under the heading "Identification duties of collectors", delete the paragraph and replace with:
"The Hazardous Substances (Identification) Regulations 2001 apply to persistent organic pollutants as if they are deemed to have hazard classifications that are class 6.1B and 9.1A, except in the case of polychlorinated biphenyls which will be deemed to have hazard classifications of 6.8A, 6.9A and 9.1A."

Notice of the Electricity Industry Participation Code Amendment (Extended Reserve) 2016

Under section 38(3)(b) of the Electricity Industry Act 2010 ("Act"), and having complied with section 39 of that Act, the Electricity Authority ("Authority") gives notice of making the Electricity Industry Participation Code Amendment (Extended Reserve) 2016 ("amendment").

The amendment comes into force on 19 January 2017.

The amendment makes changes to Parts 8, 12A, 14 and 15 of the Electricity Industry Participation Code 2010 ("Code"). It enables better operation of the extended reserve regime by addressing a range of operational issues.

A copy of the amendment and the Code may also be inspected free of charge or purchased from the Electricity Authority, Level 7, ASB Bank Tower, 2 Hunter Street, Wellington.
