The following functions, powers and duties of the board are to be vested in a limited statutory manager:

  • All functions, powers and duties of the board as an employer (whether statutory or otherwise).

A limited statutory manager must also advise the board on the following matters:

  • Property (whether statutory or otherwise); and
  • consolidating all new and improved systems and board management practice.

The board will retain its primary duty of care as a person conducting a business or undertaking, under the Health and Safety at Work Act 2015, above and beyond all functions, powers and duties of this limited statutory manager.

The limited statutory manager will take office immediately following the term of the current commissioner.

Notice of the Proposal to Issue New Acceptable Solutions for Building Code Clause F9

New Acceptable Solutions Proposed to be Issued

Pursuant to section 29 of the Building Act 2004 ("Act"), I give notice that the following acceptable solutions are proposed to be issued:

  • F9 Means of restricting access to residential pools: AS1
  • F9 Means of restricting access to residential pools: AS2

Clause F9 will be inserted in the Building Code when the Building (Pools) Amendment Act 2016 ("Amendment Act") comes into force on 1 January 2017.

Acceptable Solution Created by the Amendment Act Proposed to be Revoked

Pursuant to section 29 of the Act, I give notice that the acceptable solution described in section 450A(1) of the Act (as inserted by the Amendment Act) is proposed to be revoked.

Section 450A(1) will be inserted in the Act on 1 January 2017, and any revocation of the acceptable solution described in section 450A(1) would take place after that date.

New Acceptable Solution F9/AS1 is proposed to replace the acceptable solution in section 450A(1) of the Act.

Existing Acceptable Solution Proposed to be Amended

Pursuant to section 29 of the Act, I give notice that the following acceptable solution is proposed to be amended:

  • F4 Safety from falling: AS1

New Materials Proposed to be Incorporated by Reference

Pursuant to section 409(2) of the Act, I give notice that the following materials are proposed to be incorporated by reference into:
