Classification and Vesting of Reserve
Under the Reserves Act 1977, the Conservation Partnerships Manager of the Eastern Bay of Plenty Office of the Department of Conservation classifies the reserve described in the Schedule as a local purpose (soil conservation and river control) reserve and vests the reserve in the Bay of Plenty Regional Council, subject to the provisions of the Act.
The vesting is subject to a special condition that Sections 2, 3 and 4 SO 477337 are considered for transfer to the Ngāti Awa governance entity at a time when the remediation work on these sections is fully complete and the regional council is in agreement that it is appropriate to vest the specified sections in Ngāti Awa.

Authorisation of the Exchange of Reserve for Other Land—Lower Hutt City
Under section 15 of the Reserves Act 1977, the Hutt City Council, under delegated authority from the Minister of Conservation, authorises the exchange of the part of the Recreation Reserve described in the First Schedule to this notice for the land described in the Second Schedule, and further specifies that the land in the Second Schedule be held for recreation reserve subject to the Reserves Act 1977.
