Auckland Foundation in the implementation of the scheme, as appropriate and requested, and to consult with the University of Auckland Foundation regarding the criteria for residential scholarships to be made available to PMC Grafton Scholars from the Presbyterian Methodist Congregational Grafton Scholarship Fund, such Committee to consist of three persons appointed by the Foundation within one month after the approval of the scheme and to hold office for five years from the date of approval of the scheme, after which period it shall be dissolved unless the University of Auckland Foundation requests that it continue in existence and the Advisory Committee agrees.

The application for approval of the scheme is to be heard in the High Court at Auckland on 23 November 2015 at 10.00am.

Any person who wishes to oppose the scheme must give notice in writing not less than seven clear days before the date of the hearing of his or her intention to do so to:

(a) the Foundation, care of Patterson Hopkins at PO Box 37057, Parnell, Auckland 1151;

(b) the Registrar of the High Court at Auckland; and

(c) the Attorney-General, Crown Law Office, PO Box 2858, Wellington 6140.

Notice of Application to Vary Terms of Charitable Trusts

Pursuant to Section 36 of the Charitable Trusts Act 1957

In the High Court of New Zealand, New Plymouth Registry:

In the matter of the Charitable Trusts Act 1957, and in the matter of an application by the BISHOP’S ACTION FOUNDATION, Applicant:

Take notice that the Trustees of the BISHOP’S ACTION FOUNDATION will apply to the High Court at New Plymouth on Tuesday 2 February 2016 for an order varying the terms of the James Dawson Bashford Trust, created by the will of James Dawson Bashford dated the 15th day of May 1962, as varied by orders of the High Court dated the 7th day of March 1984 and the 20th day of November 2003, and further varying the terms of the Claude Williams Nicholls Trust created by the will of Claude Williams Nicholls dated the 16th day of August 1954 and varied by the General Synod of the Anglican Church.

The purpose of this application is to widen the purposes of the James Dawson Bashford Trust and Claude Williams Nicholls Trust, to merge the trusts to create the Bashford-Nicholls Trust and expand the administrative provisions of the trust.

Further particulars of the application may be obtained from the office of the applicant’s solicitors, Govett Quilliam.
