Fisheries (Declaration of Waitutu Mātaitai Reserve Bylaw) Notice 2015 (Notice No. MPI 508)

Pursuant to Regulations 25 and 26 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries hereby gives the following notice.

Notice

  1. Title—This notice may be cited as the Fisheries (Declaration of Waitutu Mātaitai Reserve Bylaw) Notice 2015.

  2. Commencement—The bylaw comes into effect 28 days after the date of its notification in the New Zealand Gazette.

  3. Interpretation—In this notice:

    (a) The term “Waitutu Mātaitai Reserve” means that mātaitai reserve at Waitutu described in the Fisheries (Declaration of Waitutu Mātaitai Reserve) Notice 2014, notified in the New Zealand Gazette, 10 July 2014, No. 73, page 2070.

    (b) Unless the context requires otherwise, terms have the same meaning as in the interpretation sections of the Fisheries (South Island Customary Fishing) Regulations 1999 and the Fisheries Act 1996.

  4. Approval of bylaw for the Waitutu Mātaitai Reserve—The Minister for Primary Industries has approved the following bylaw for the Waitutu Mātaitai Reserve:

    Bylaw 1 - Paua fishing prohibited in the Waitutu Mātaitai Reserve

    No person may take any paua (Haliotis iris and H. australis) from the Waitutu Mātaitai Reserve.

Explanatory Note

Fishing subject to this bylaw

Under Regulation 25(3) of the Fisheries (South Island Customary Fishing) Regulations 1999, this bylaw applies generally to all persons fishing in the Waitutu Mātaitai Reserve.

Breach of bylaw is an offence

Under Regulation 43 of the Fisheries (South Island Customary Fishing) Regulations 1999, a person commits an offence against those Regulations if a person breaches this bylaw.

Land Notices

Land Declared Road—19 Anzac Road, Browns Bay, Auckland

Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Natalie Randrup, Land Information New Zealand, declares the land described in the Schedule to this notice to be road and shall remain vested in the Auckland Council on the date of publication hereof in the New Zealand Gazette.
