Geoff Falloon, chartered accountant of Biz Rescue Limited, was appointed liquidator of the above-named companies on 11 September 2015 at 9.00am.
This appointment is part of the process of Ngāti Kuia’s rationalisation and consolidation of its legal entities and assets into one post-settlement governance structure which was approved by resolutions passed at a special general meeting of the shareholder of the above-named companies held on 14 August 2015.
Notice of Meeting of Creditors
No meeting of creditors will be held.
In accordance with sections 243(8) and (9) and 245 of the Companies Act 1993, the liquidator dispenses with the requirement to call a meeting on the basis that the directors of both companies have signed solvency certificates stating the companies were, at date of liquidation, able to pay their debts.
A creditor holding a contrary view should notify the liquidator within 10 working days of publication of this notice.
Notice to Creditors to Lodge Claims
The liquidator has fixed 20 October 2015 as the last day for creditors to make their claims and establish any priority their claims may have.
Creditors who have not made a claim at that date, and a distribution is declared, will be excluded from the benefit of that distribution and may not object to that distribution.
