Pursuant to section 49(1)(b) of the Act, the Minister hereby notifies that the following protection principles are directed at the Minister of Conservation preventing harm to, or the diminishing of, the Ngāti Toa Rangatira values related to the Kapiti Island:
(a) Protection of wāhi tapu, indigenous flora and fauna originally found here and the wider environment within Kapiti Island;
(b) recognition of the mana, kaitiakitanga and tikanga of Ngāti Toa Rangatira over, and within, Kapiti Island;
(c) recognition of Ngāti Toa Rangatira as kaitiaki over Kapiti Island;
(d) acknowledgement of Ngāti Toa Rangatira tikanga/kawa in Kapiti Island;
(e) respect for the association of Ngāti Toa Rangatira with Kapiti Island;
(f) accurate portrayal of the association of Ngāti Toa Rangatira with Kapiti Island;
(g) recognition and acknowledgement of the historical, cultural and spiritual significance of Kapiti Island; and
(h) recognition of the relationship of Ngāti Toa Rangatira with their wāhi tapu, wāhi taonga and other sites of significance in Kapiti Island.

Notification of Nga Paihau Overlay Classification and Protection Principles—Nga Whatu Kaiponu (The Brothers)
Pursuant to section 49(1)(a) of the Ngāti Toa Rangatira Claims Settlement Act 2014 (“the Act”), the Minister of Conservation hereby notifies that the area described in the Schedule hereto has been declared to be subject to an overlay classification known as Nga Paihau by section 40 of the Act.
The provisions of the Act which relate to Nga Paihau are sections 40–58.
Pursuant to section 49(1)(b) of the Act, the Minister hereby notifies that the following protection principles are directed at the Minister of Conservation preventing harm to, or the diminishing of, the Ngāti Toa Rangatira values related to Nga Whatu Kaiponu (The Brothers):
(a) Protection of wāhi tapu, indigenous flora and fauna and the wider environment within Nga Whatu Kaiponu (The Brothers);
(b) recognition of the mana, kaitiakitanga and tikanga of Ngāti Toa Rangatira over, and within, Nga Whatu Kaiponu (The Brothers);
(c) recognition of Ngāti Toa Rangatira as kaitiaki over Nga Whatu Kaiponu (The Brothers) mahinga kai and other traditional resources;
(d) respect for Ngāti Toa Rangatira tikanga/kawa in regard to Nga Whatu Kaiponu (The Brothers);
(e) respect for the association of Ngāti Toa Rangatira with Nga Whatu Kaiponu (The Brothers);
(f) recognition of the relationship of Ngāti Toa Rangatira with their wāhi tapu, wāhi taonga and sites of significance; and
(g) recognition of the traditional, historical, cultural, and spiritual significance of Nga Whatu Kaiponu (The Brothers) to Ngāti Toa Rangatira as navigational guides.
