Maritime Transport Act 1994

Notice of Exemption From Maritime and Marine Protection Rules: 31B.15, Table 8; 31C.12; 32.17(2)(a)(ii); 40A.33(2)(e); 190.3(2)

Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions:

  • 1 from 31B.15, Table 8 – Crewing and Watchkeeping. Offshore, Coastal and Restricted (Non-Fishing Vessels) – Non-passenger vessels – enclosed area – seafarers holding minimum qualifications and minimum crew specified in Table 8
  • 1 from Maritime Rule 31C.12 – Crewing and Watchkeeping Fishing Vessels – Operating Areas – Inshore Area – requirements for fishing vessels operating in inshore area and any defined sections of coastal area
  • 1 from Maritime Rule 32.17(2)(a)(ii) – Ships’ Personnel – Qualifications – Bridge watchkeepers, mates and masters – Officer in charge of a navigational watch of a foreign going ship – route – approved structured training programme
  • 2 from Maritime Rule 40A.33(2)(e) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Machinery – Petrol inboard and outboard engines – Ship fitted with one outboard engine as main source of propulsion, if proceeding beyond enclosed waters, must have auxiliary engine of sufficient power to enable ship to return safely to port or a safe haven
  • 1 from Marine Protection Rule 190.3(2) – Mandatory Ships Routeing – Poor Knights Islands – The owner, charterer and master of a ship must not cause or allow the ship to enter the Poor Knights area in transit
