Land Transfer Act Notice

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way.

The applicant claims the right of way is redundant by reason of the circumstances set out below.

I intend to remove the right of way on 11 June 2014 if no objections have been received before that date.

Applicant: Minaret Resources Limited, c/o Anderson Lloyd Lawyers, PO Box 201, Queenstown 9348. Attention: R. Huse.

Easement: A right of way over parts marked “R”, “T”, “S” and “U” on DP 408663 created by Easement Instrument 5960545.10 – produced 7 April 2004 at 9.00am and entered 23 April 2004 at 9.00am.

Circumstances: The dominant land has become physically separated from the servient land caused by the subdivision shown on DP 381579.

Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of subdivision shown on DP 204943 and the drainage and services rights no longer serve the dominant tenement.
